The Committee on Criminal Justice (Wise) recommended the

following amendment:

     Senate Amendment (with title amendment)

     Delete everything after the enacting clause

7

and insert:

     Section 1.  Subsection (3) of section 817.52, Florida

9

Statutes, is amended to read:

10

     817.52  Obtaining vehicles with intent to defraud, failing

11

to return hired vehicle, or tampering with mileage device of

12

hired vehicle.--

13

     (3)  FAILURE TO REDELIVER HIRED VEHICLE.--Whoever, after

14

hiring a motor vehicle under an agreement to redeliver the same

15

to the person letting such motor vehicle or his or her agent, at

16

the termination of the period for which it was let, shall,

17

without the consent of such person or persons and with intent to

18

defraud, abandon, or willfully refuse to redeliver such vehicle

19

as agreed commits shall, upon conviction, be guilty of a felony

20

of the third degree, punishable as provided in s. 775.082, s.

21

775.083, or s. 775.084. A law enforcement agency may not require

22

information not required by this subsection to be supplied in

23

order to accept a report of a hired vehicle as a stolen vehicle.

24

A report under this subsection shall be accepted by a law

25

enforcement agency and shall be entered into the National Crime

26

Information Center and the Florida Crime Information Center

27

listing the hired vehicle as a stolen vehicle.

     Section 2.  This act shall take effect July 1, 2008.

An act relating to a failure to redeliver hired vehicles;

amending s. 817.52, F.S.; providing that information not

otherwise required by law is not required in order to

39

report a hired vehicle as stolen; requiring a law

40

enforcement agency to report a hired vehicle as stolen to

41

certain specified reporting systems; providing an

42

effective date.
