     (3) Except for providers who are providing services

pursuant to ss. 395.104 and 401.45, any provider who accepts an

10

assignment of benefits pursuant to this section agrees to accept

11

75 percent of the current Medicare fee schedule or 75 percent of

12

the average amount payable to a contracted provider in the same

13

area, whichever is greater, as payment in full from the health

14

insurer for the health care services provided and also agrees

15

not to bill for or attempt to collect any balance from the

16

insured.
