The Committee on Commerce (Oelrich) recommended the following

amendment:

     Section 1.  Section 627.638, Florida Statutes, is amended

8

to read:

9

     627.638  Direct payment for hospital, medical services.--

10

     (1) A Any health insurance policy insuring against loss or

11

expense due to hospital confinement or to medical and related

12

services may provide for payment of benefits directly to any

13

recognized hospital, licensed ambulance provider, physician

14

doctor, or other person who provided the services, in accordance

15

with the provisions of the policy. To comply with this section,

16

the words "or to the hospital, licensed ambulance provider,

17

physician doctor, or person rendering services covered by this

18

policy," or similar words appropriate to the terms of the

19

policy, must shall be added to applicable provisions of the

20

policy.

     (2) If Whenever, in any health insurance claim form, an

22

insured specifically authorizes payment of benefits directly to

23

any recognized hospital, licensed ambulance provider, physician,

24

or dentist, or other person who provided the services, in

25

accordance with the provisions of the policy, the insurer shall

26

make such payment to the designated provider of such services,

27

unless otherwise provided in the insurance contract. The

28

insurance contract may not prohibit, and claims forms must

29

provide an option for, the payment of benefits directly to a

30

licensed hospital, licensed ambulance provider, physician, or

31

dentist for care provided pursuant to s. 395.1041. The insurer

32

may require a provider to retain and make available upon request

33

a written attestation of assignment of benefits. The attestation

34

assigning benefits may be transferred to the insurer in

35

electronic form. Payment to the provider from the insurer may

36

not be more than the amount that the insurer would otherwise

37

have paid without the assignment.
