Section 2. Section 624.1265, Florida Statutes, is created
7
to read:
8
624.1265 Nonprofit religious organization exemption;
9
authority; notice.--
10
(1) Any nonprofit religious organization that qualifies
11
under Title 26, s. 501 of the Internal Revenue Code; that limits
12
its participants to members of the same religion; that acts as an
13
organizational clearinghouse for information between participants
14
who have financial, physical, or medical needs and participants
15
having the ability to pay for the benefit of those participants
16
who have financial, physical, or medical needs; that provides for
17
the financial or medical needs of a participant through payments
18
directly from one participant to another participant; and that
19
suggests amounts that participants may voluntarily give with no
20
assumption of risk or promise to pay among the participants or
21
between the participants and the religious organization are not
22
subject to any requirements of the Florida Insurance Code.
23
(2) This section does not prevent the religious
24
organization described in subsection (1) from establishing
25
qualifications of participation relating to the health of a
26
prospective participant, prevent a participant from limiting the
27
financial or medical needs that may be eligible for payment, or
28
prevent the organization from canceling the membership of a
29
participant if such participant indicates his or her
30
unwillingness to participate by failing to make a payment to
31
another participant within 60 days.

(3) The religious organization described in subsection (1)
33
shall provide each prospective participant in the organizational
34
clearinghouse written notice that the organization is not an
35
insurance company, that membership is not offered through an
36
insurance company, and that the organization is not subject to
37
the regulatory requirements or consumer protections of the
38
Florida Insurance Code.
