The Committee on Banking and Insurance (Peaden) recommended the

following amendment:

     Delete line(s) 20 through 26

and insert:

     (c)(d) Are not covered by a private insurance policy and

8

are not eligible for coverage through a public health insurance

9

program, such as Medicare or Medicaid, unless specifically

10

authorized under paragraph (c), or another public health care

11

program, such as Kidcare, and have not been covered at any time

12

during the past 6 months, except that persons who were covered

13

through a health maintenance organization licensed under part I

14

of chapter 641 which is also an approved health flex plan may

15

apply for coverage in the same health maintenance organization's

16

health flex plan without a lapse in coverage;

17

     (d) Have lost eligibility to receive Medicaid or Medicare,

18

or another public health care program such as Kidcare, within 90

19

days before applying for health care coverage through an

20

approved health flex plan; and

21

     (e)  Have applied for health care coverage through an
