The Committee on Banking and Insurance (Peaden) recommended the

following substitute for amendment (632052):

     Delete line(s) 20-26

and insert:

     (c)(d) Are not covered by a private insurance policy and

9

are not eligible for coverage through a public health insurance

10

program, such as Medicare or Medicaid, unless specifically

11

authorized under paragraph (c), or another public health care

12

program, such as Kidcare, and have not been covered at any time

13

during the past 6 months, except that persons that were covered

14

under an individual contract issued by a health maintenance

15

organization licensed under Part I of chapter 641, which also is

16

an approved health flex plan, may apply for coverage in the same

17

health maintenance organization's health flex plan without a

18

lapse in coverage if all other eligibility requirements are met;

19

     (d) Have lost eligibility to Medicaid or Medicare, or

20

another public health care program, such as Kidcare within 90

21

days before applying for health care coverage through an

22

approved health flex plan; and

23

     (e)  Have applied for health care coverage through an
