Section 2. Section 624.1265, Florida Statutes, is created
7
to read:

624.1265 Nonprofit religious organization exemption;
9
authority; notice.--
10
(1) Any nonprofit religious organization that qualifies
11
under Title 26, s. 501 of the Internal Revenue Code; that limits
12
its participants to members of the same religion; that acts as an
13
organizational clearinghouse for information between participants
14
who have financial, physical, or medical needs and participants
15
having the ability to pay for the benefit of those participants
16
who have financial, physical, or medical needs; that provides for
17
the financial or medical needs of a participant through payments
18
directly from one participant to another; and that suggests
19
amounts that participants may voluntarily give with no assumption
20
of risk or promise to pay among the participants or between the
21
participants and the organization are not subject to any
22
requirements of the Florida Insurance Code.

(2) This section does not prevent the organization
24
described in subsection (1) from establishing qualifications of
25
participation relating to the health of a prospective
26
participant, prevent a participant from limiting the financial or
27
medical needs that may be eligible for payment, or prevent the
28
organization from canceling the membership of a participant if
29
such participant indicates his or her unwillingness to
30
participate by failing to make a payment to another participant
31
within 60 days.

(3) The organization described in subsection (1) shall
33
provide each prospective participant in the organizational
34
clearinghouse written notice that the organization is not an
35
insurance company, that membership is not offered through an
36
insurance company, and that the organization is not subject to
37
the regulatory requirements or consumer protections of the
38
Florida Insurance Code.
