An act relating to inmate death notification; amending s.

944.09, F.S.; requiring the Department of Corrections to

adopt procedures for providing notice of the death of an

5

inmate in the state correctional system; prescribing

6

written information to be provided to the person

7

designated by the inmate to receive notice of the inmate's

8

death; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (s) is added to subsection (1) of

13

section 944.09, Florida Statutes, to read:

14

     944.09  Rules of the department; offenders, probationers,

15

and parolees.--

16

     (1)  The department has authority to adopt rules pursuant to

17

ss. 120.536(1) and 120.54 to implement its statutory authority.

The rules must include rules relating to:

19

     (s) Notice of the death of an inmate. The rules must

20

require the correctional facility in which an inmate died to:

21

     1. Notify the person designated by the inmate to receive

22

notice of the inmate's death; and

23

     2. Provide, in writing, to the person designated by the

24

inmate to receive notice of the inmate's death information that

25

will assist the person in contacting the department concerning

26

matters relating to the death of the inmate.

     Section 2.  This act shall take effect July 1, 2008.
