An act relating to electrical power plants; amending s.

403.506, F.S.; revising the thresholds and applicability

4

standards of the Florida Electrical Power Plant Siting

5

Act; exempting from the act an electrical generating

6

facility that expands its capacity by 75 megawatts or

7

less, in the aggregate; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsection (1) of section 403.506, Florida

12

Statutes, is amended to read:

13

403.506  Applicability, thresholds, and certification.--

14

     (1) The provisions of this act shall apply to an any

15

electrical power plant as defined in s. 403.503(13) herein,

16

except that the provisions of this act do shall not apply to an

17

any electrical power plant or steam generating plant of less than

18

75 megawatts in capacity or to a any substation to be constructed

19

as part of an associated transmission line unless the applicant

20

has elected to apply for certification of such plant or

21

substation under this act. The provisions of this act do shall

22

not apply to any unit capacity expansions expansion of 75 35

23

megawatts or less, in the aggregate, of an existing exothermic

24

reaction cogeneration electrical generating facility unit that

25

was exempt from this act when it was originally built; however,

26

this exemption does shall not apply if the facility unit uses oil

27

or natural gas for purposes other than unit startup. Construction

28

No construction of a any new electrical power plant or expansion

29

in steam generating capacity as measured by an increase in the

30

maximum electrical generator rating of an any existing electrical

31

power plant may not be undertaken after October 1, 1973, without

32

first obtaining certification in the manner as herein provided in

33

this act, except that this act does shall not apply to an any

34

such electrical power plant that which is presently operating or

35

under construction or that which has, upon the effective date of

36

chapter 73-33, Laws of Florida, applied for a permit or

37

certification under requirements in force before prior to the

38

effective date of such act.

     Section 2.  This act shall take effect July 1, 2008.
