A bill to be entitled
2An act relating to Broward County; amending chapter 98-
3521, Laws of Florida; revising membership of the South
4Broward Utility Advisory Board to provide for appointment
5of members by the Town of Southwest Ranches rather than
6the Broward County Commission; providing an effective
7date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 1 of chapter 98-521, Laws of Florida,
12is amended to read:
13     Section 1.  There is hereby created the South Broward
14Utility Advisory Board, which shall be an advisory board of the
15City of Sunrise. The board shall be composed of seven members,
16as follows: two members shall be appointed by the City of
17Sunrise, two members shall be appointed by the Town of Davie,
18one member shall be appointed by the City of Pembroke Pines, and
19two members shall be appointed by the Town of Southwest Ranches
20Broward County Commission. Each appointed member shall be a
21water and sewer user within the service area of the former South
22Broward Utility. Terms of each member shall be for 2 years,
23except that all appointments and retention of board members
24shall be at the sole discretion of the appointing authorities.
25     (1)  The responsibility of the board shall be to review and
26advise the City of Sunrise regarding any proposed change by the
27city to the water and sewer rates charged within the area which
28was formerly the South Broward Utility service area. In the
29event of a proposed rate change within such area, the South
30Broward Utility Advisory Board may require the City of Sunrise
31to hire a rate consultant to advise the city regarding such
32proposed rate change.
33     (2)  Within 30 days following notice of a rate change, the
34advisory board shall present a report of its findings to the
35Commission of the City of Sunrise. If presented within the 30-
36day period, the report shall be considered by the commission
37before rates may be altered or changed within the area formerly
38served by the South Broward Utility.
39     (3)  The City of Sunrise shall appropriate not more than
40$25,000 annually for a rate consultant for the South Broward
41Utility Advisory Board, as provided in subsection (1).
42     (4)  The advisory board shall have no legal standing to
43bring any legal action.
44     (5)  The City of Sunrise shall, by ordinance, provide for
45such other procedures and regulations which are not in conflict
46with this act as are necessary for the continued operation of
47the board.
48     Section 2.  This act shall take effect upon becoming a law.
