The Committee on Criminal Justice (Dockery) recommended the

2

following amendment:

     Senate Amendment (with title amendment)

5

     Delete everything after the enacting clause

6

and insert:

7

     Section 1.  Section 782.065, Florida Statutes, is created

8

to read:

9

     782.065 Murder; law enforcement officer.-Notwithstanding s.

10

775.082, s. 775.0823, s, 782.04, s. 782.051, or chapter 921, a

11

defendant shall be sentenced to imprisonment for life without

12

eligibility for early release upon findings by the factfinder

13

beyond a reasonable doubt that:

14

     (1) The defendant committed murder in the first degree in

15

violation of s. 782.04(1) and a death sentence is not imposed,

16

murder in the second or third degree in violation of s.

17

782.04(2), (3), or (4), attempted murder in the first or second

18

degree in violation of s. 782.04(1)(a)1. or s. 782.04(2), or

19

attempted felony murder in violation of s. 782.051; and

20

     (2) The victim of the offense described in subsection (1)

21

is a law enforcement officer, part-time law enforcement officer,

22

or auxiliary law enforcement officer, as those terms are defined

23

in s. 943.10, engaged in the lawful performance of a legal duty.

     Section 2.  This act shall take effect October 1, 2008.

And the title is amended as follows:

     Delete everything before the enacting clause

and insert:

A bill to be entitled

31

An act relating to murder of law enforcement officers;

32

creating s. 782.065, F.S.; providing that a defendant

33

shall be sentenced to imprisonment for life without

34

eligibility for early release upon findings beyond a

35

reasonable doubt that the defendant committed a

36

specified murder offense against a law enforcement

37

officer, part-time law enforcement officer, or auxiliary

38

law enforcement officer engaged in the lawful

39

performance of a legal duty; providing an effective

40

date.
