A bill to be entitled

An act relating to murder of law enforcement officers;

creating s. 782.065, F.S.; providing a minimum mandatory

4

sentence for certain offenses; providing an effective

5

date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 782.065, Florida Statutes, is created to

10

read:

11

     782.065 Murder; law enforcement officer.--Notwithstanding

12

s. 775.082, s. 775.0823, s, 782.04, s. 782.051, or chapter 921, a

13

person who commits or attempts to commit murder in the first,

14

second, or third degree as described in s. 782.04, or attempted

15

felony murder as described in s. 782.051, when the victim of the

16

offense is a law enforcement officer, part-time law enforcement

17

officer, or auxiliary law enforcement officer, as those terms are

18

defined in s. 943.10, engaged in the lawful performance of a

19

legal duty shall, if the death sentence is not imposed, be

20

sentenced to a minimum mandatory term of imprisonment for life

21

without eligibility for release.

     Section 2.  This act shall take effect October 1, 2008.
