A bill to be entitled
2An act relating to the Cities of Lauderhill, Plantation,
3and Fort Lauderdale, Broward County; adjusting the
4corporate limits of the Cities of Lauderhill, Plantation,
5and Fort Lauderdale to include within, or exclude from,
6such corporate limits a specified parcel and portions of
7rights-of-way and to remedy the creation of an enclave;
8providing for transfer of public roads and rights-of-way;
9providing for certain powers over the annexed area;
10providing for continuation of contracts in effect prior to
11annexation; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  The present corporate limits of the City of
16Lauderhill, Broward County, are hereby contracted so as to
17voluntarily deannex and exclude from the territory presently
18within its corporate limits the area consisting of a commercial
19parcel more commonly known as the Renaissance Evangelical
20Baptist Tabernacle parking lot (Folio # 504206010010), 3741 West
21Broward Boulevard, together with a portion of the abutting
22right-of-way on Broward Boulevard to be annexed into the City of
23Plantation, particularly described as follows:

25A portion of Broward Boulevard, lying in Section 6,
26Township 50 South, Range 42 East, together with Lot
27'G', Lot 10 and the West 90 feet of Lot 11 in Block 2
28of BROWARD ESTATES, SECTION ONE, according to the Plat
29thereof, recorded in Plat Book 33, Page 3, of the
30Public Records of Broward County, Florida, being more
31particularly described as follows:

33BEGINNING at the intersection of the South line of
34said Section 6 with the Southerly prolongation of the
35centerline of N.W. 38th Way as shown on the plat of
36BROWARD ESTATES Section 2, as recorded in Plat Book
3734, Page 19, Public Records of Broward County,
38Florida, said point being on the municipal boundary of
39the City of Plantation, established by Chapter 68-101,
40Laws of Florida and the Municipal Boundary, City of
41Lauderhill as established by Ordinance No. 050-11-209
42of the City of Lauderhill.

44Thence continue along said municipal boundaries the
45following 3 courses;

47Thence North along the said Southerly prolongation of
48the centerline of N.W. 38th Way to an intersection
49with the North right-of-way line of Broward Boulevard,
50said North right-of-way line being 50 feet North of
51and parallel to the South line of said Section 6;

54of Broward Boulevard to the Southeast corner of Tract
55"E", as shown by BROWARD ESTATES Section 2;

57Thence Northerly along the East line of said Tract "E"
58to the Northeast corner of said Tract "E", said point
59also being the Northwest corner of said Lot "G";

61Thence Easterly on the North lines of said Lot 'G',
62Lot 10 and Lot 11, to the intersection with the East
63line of the West 90 feet of said Lot 11;

68being on the municipal boundary of the City of Fort

77     Section 2.  The present corporate limits of the City of
78Lauderhill, Broward County, are hereby extended and enlarged so
79as to voluntarily annex and include, in addition to the
80territory presently within its corporate limits, the area
81consisting of a portion of the right-of-way on N.W. 31st Avenue
82from the City of Fort Lauderdale, particularly described as
83follows:

86East being more particularly described as follows:

88BEGINNING at the intersection of the South right-of-
89way line of NW 19 Street and the West right-of-way
90line of NW 31 Avenue, said point being on the
91municipal boundary of the City of Fort Lauderdale, as
92established by Chapter 69-1057, Laws of Florida and on
93the municipal boundary of the City of Lauderhill as
94established by Ordinance 040-10-220 of the City of
95Lauderhill;

98City of Lauderhill and the City of Fort Lauderdale and
99on said West right-of-way line of NW 31 Avenue, to the
100intersection with the South line of the North One-Half

118     Section 3.  In order to remedy the creation of an enclave,
119the present corporate limits of the City of Lauderhill, Broward
120County, are hereby contracted so as to deannex and exclude from
121the territory presently within its corporate limits a small
122portion of the right-of-way on Sunrise Boulevard and N.W. 31st
123Avenue that was erroneously annexed into the City of Lauderhill,
124particularly described as follows:

126A portion of the North 1/2 of Government Lot 1,
127Section 6 of Township 50 South, Range 42 East being
128more particularly described as follows:

130BEGINNING at the Northeast corner of the Northeast
131One-Quarter (NE 1/4) of said Section 6, Township 50
132South, Range 42 East, said point being on the
133corporate city limits of the City of Lauderhill as
134established by Ordinance No. 040-10-219 of the City of
135Lauderhill;

137Thence Southerly on said municipal boundary and on the
138East line of said Section 6 to a point on the
139municipal boundary of the City of Lauderhill as
140established by Ordinance No. 04-10-217 of the City of
141Lauderhill;

144Easterly prolongation of the North line of Parcel 'A',
145as shown by the plat of THUNDERBIRD SWAP SHOP III, as
146recorded in Plat Book 142, Page 20 of the Public

148West right-of-way line of NW 31st Avenue, said point
149being on the municipal boundary of the City of
150Lauderhill as established by Ordinance No. 040-10-219

173     Section 4.  The subject public roads and the public rights-
174of-way associated therewith, on the Broward County road system
175(N.W. 31st Avenue), lying within the limits of the lands subject
176to annexation herein, are transferred from Broward County
177jurisdiction to the jurisdiction of the annexing municipality
178solely for the purposes of police and emergency services upon
179the effective date of the annexation. The subject public roads
180and the public rights-of-way associated therewith, on the state
181road system (Broward Boulevard and Sunrise Boulevard), lying
182within the limits of the lands subject to annexation herein, are
183transferred from Department of Transportation jurisdiction to
184the jurisdiction of the annexing municipality solely for the
185purposes of police and emergency services upon the effective
186date of the annexation. No ownership, operation, maintenance,
187planning, design, or construction of said roads or rights-of-way
188shall transfer from Broward County or the Department of
189Transportation to any municipality.
190     Section 5.  On the effective date of this act, the annexing
191municipality shall be responsible for and embodied with all
192municipal powers granted in chapter 166, Florida Statutes,
193including, but not limited to, police and emergency service
194powers, over the territory hereby annexed.
195     Section 6.  Nothing in this act shall be construed to
196affect or abrogate the rights of parties to any contracts,
197whether the same be between Broward County and a third party or
198between nongovernmental entities, which contracts are in effect
199prior to the effective date of the annexation.
200     Section 7.  This act shall take effect upon becoming a law.
