2 | An act relating to the Cities of Lauderhill, Plantation, |
3 | and Fort Lauderdale, Broward County; adjusting the |
4 | corporate limits of the Cities of Lauderhill, Plantation, |
5 | and Fort Lauderdale to include within, or exclude from, |
6 | such corporate limits a specified parcel and portions of |
7 | rights-of-way and to remedy the creation of an enclave; |
8 | providing for transfer of public roads and rights-of-way; |
9 | providing for certain powers over the annexed area; |
10 | providing for continuation of contracts in effect prior to |
11 | annexation; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |
14 |
|
15 | Section 1. The present corporate limits of the City of |
16 | Lauderhill, Broward County, are hereby contracted so as to |
17 | voluntarily deannex and exclude from the territory presently |
18 | within its corporate limits the area consisting of a commercial |
19 | parcel more commonly known as the Renaissance Evangelical |
20 | Baptist Tabernacle parking lot (Folio # 504206010010), 3741 West |
21 | Broward Boulevard, together with a portion of the abutting |
22 | right-of-way on Broward Boulevard to be annexed into the City of |
23 | Plantation, particularly described as follows: |

25 | A portion of Broward Boulevard, lying in Section 6, |
26 | Township 50 South, Range 42 East, together with Lot |
27 | 'G', Lot 10 and the West 90 feet of Lot 11 in Block 2 |
28 | of BROWARD ESTATES, SECTION ONE, according to the Plat |
29 | thereof, recorded in Plat Book 33, Page 3, of the |
30 | Public Records of Broward County, Florida, being more |
31 | particularly described as follows: |

33 | BEGINNING at the intersection of the South line of |
34 | said Section 6 with the Southerly prolongation of the |
35 | centerline of N.W. 38th Way as shown on the plat of |
36 | BROWARD ESTATES Section 2, as recorded in Plat Book |
37 | 34, Page 19, Public Records of Broward County, |
38 | Florida, said point being on the municipal boundary of |
39 | the City of Plantation, established by Chapter 68-101, |
40 | Laws of Florida and the Municipal Boundary, City of |
41 | Lauderhill as established by Ordinance No. 050-11-209 |
42 | of the City of Lauderhill. |

44 | Thence continue along said municipal boundaries the |
45 | following 3 courses; |

48 | the centerline of N.W. 38th Way to an intersection |
49 | with the North right-of-way line of Broward Boulevard, |
50 | said North right-of-way line being 50 feet North of |
51 | and parallel to the South line of said Section 6; |

53 | Thence Easterly along the said North right-of-way line |
54 | of Broward Boulevard to the Southeast corner of Tract |
55 | "E", as shown by BROWARD ESTATES Section 2; |

57 | Thence Northerly along the East line of said Tract "E" |
58 | to the Northeast corner of said Tract "E", said point |
59 | also being the Northwest corner of said Lot "G"; |

61 | Thence Easterly on the North lines of said Lot 'G', |
62 | Lot 10 and Lot 11, to the intersection with the East |

79 | as to voluntarily annex and include, in addition to the |
80 | territory presently within its corporate limits, the area |
81 | consisting of a portion of the right-of-way on N.W. 31st Avenue |
82 | from the City of Fort Lauderdale, particularly described as |
83 | follows: |

89 | way line of NW 19 Street and the West right-of-way |

91 | municipal boundary of the City of Fort Lauderdale, as |
92 | established by Chapter 69-1057, Laws of Florida and on |
93 | the municipal boundary of the City of Lauderhill as |
94 | established by Ordinance 040-10-220 of the City of |

120 | County, are hereby contracted so as to deannex and exclude from |
121 | the territory presently within its corporate limits a small |
122 | portion of the right-of-way on Sunrise Boulevard and N.W. 31st |
123 | Avenue that was erroneously annexed into the City of Lauderhill, |
124 | particularly described as follows: |

173 | Section 4. The subject public roads and the public rights- |
174 | of-way associated therewith, on the Broward County road system |
175 | (N.W. 31st Avenue), lying within the limits of the lands subject |
176 | to annexation herein, are transferred from Broward County |
177 | jurisdiction to the jurisdiction of the annexing municipality |
178 | solely for the purposes of police and emergency services upon |
179 | the effective date of the annexation. The subject public roads |
180 | and the public rights-of-way associated therewith, on the state |
181 | road system (Broward Boulevard and Sunrise Boulevard), lying |
182 | within the limits of the lands subject to annexation herein, are |
183 | transferred from Department of Transportation jurisdiction to |
184 | the jurisdiction of the annexing municipality solely for the |
185 | purposes of police and emergency services upon the effective |
186 | date of the annexation. No ownership, operation, maintenance, |
187 | planning, design, or construction of said roads or rights-of-way |
188 | shall transfer from Broward County or the Department of |
189 | Transportation to any municipality. |
190 | Section 5. On the effective date of this act, the annexing |
191 | municipality shall be responsible for and embodied with all |
192 | municipal powers granted in chapter 166, Florida Statutes, |
193 | including, but not limited to, police and emergency service |
194 | powers, over the territory hereby annexed. |
195 | Section 6. Nothing in this act shall be construed to |
196 | affect or abrogate the rights of parties to any contracts, |
197 | whether the same be between Broward County and a third party or |
198 | between nongovernmental entities, which contracts are in effect |
199 | prior to the effective date of the annexation. |
200 | Section 7. This act shall take effect upon becoming a law. |
