1	A bill to be entitled
2	An act relating to the Cities of Lauderhill, Plantation,
3	and Fort Lauderdale, Broward County; adjusting the
4	corporate limits of the Cities of Lauderhill, Plantation,
5	and Fort Lauderdale to include within, or exclude from,
6	such corporate limits a specified parcel and portions of
7	rights-of-way and to remedy the creation of an enclave;
8	providing for transfer of public roads and rights-of-way;
9	providing for certain powers over the annexed area;
10	providing for continuation of contracts in effect prior to
11	annexation; providing an effective date.

13	Be It Enacted by the Legislature of the State of Florida:
14
15	Section 1.  The present corporate limits of the City of
16	Lauderhill, Broward County, are hereby contracted so as to
17	voluntarily deannex and exclude from the territory presently
18	within its corporate limits the area consisting of a commercial
19	parcel more commonly known as the Renaissance Evangelical
20	Baptist Tabernacle parking lot (Folio # 504206010010), 3741 West
21	Broward Boulevard, together with a portion of the abutting
22	right-of-way on Broward Boulevard to be annexed into the City of
23	Plantation, particularly described as follows:

25	A portion of Broward Boulevard, lying in Section 6,
26	Township 50 South, Range 42 East, together with Lot
27	'G', Lot 10 and the West 90 feet of Lot 11 in Block 2
28	of BROWARD ESTATES, SECTION ONE, according to the Plat
29	thereof, recorded in Plat Book 33, Page 3, of the
30	Public Records of Broward County, Florida, being more
31	particularly described as follows:

33	BEGINNING at the intersection of the South line of
34	said Section 6 with the Southerly prolongation of the
35	centerline of N.W. 38th Way as shown on the plat of
36	BROWARD ESTATES Section 2, as recorded in Plat Book
37	34, Page 19, Public Records of Broward County,
38	Florida, said point being on the municipal boundary of
39	the City of Plantation, established by Chapter 68-101,
40	Laws of Florida and the Municipal Boundary, City of
41	Lauderhill as established by Ordinance No. 050-11-209
42	of the City of Lauderhill.

44	Thence continue along said municipal boundaries the
45	following 3 courses;

47	Thence North along the said Southerly prolongation of
48	the centerline of N.W. 38th Way to an intersection
49	with the North right-of-way line of Broward Boulevard,
50	said North right-of-way line being 50 feet North of
51	and parallel to the South line of said Section 6;

53	Thence Easterly along the said North right-of-way line
54	of Broward Boulevard to the Southeast corner of Tract
55	"E", as shown by BROWARD ESTATES Section 2;

57	Thence Northerly along the East line of said Tract "E"
58	to the Northeast corner of said Tract "E", said point
59	also being the Northwest corner of said Lot "G";

61	Thence Easterly on the North lines of said Lot 'G',
62	Lot 10 and Lot 11, to the intersection with the East
63	line of the West 90 feet of said Lot 11;

65	Thence Southerly along said East line and the
66	Southerly prolongation thereof to the intersection
67	with the South line of said Section 6, said line also
68	being on the municipal boundary of the City of Fort
69	Lauderdale as established by Chapter 2001-291, Laws of
70	Florida and the City of Lauderhill as established by
71	Ordinance No. 050-11-209 of the City of Lauderhill;

73	Thence Westerly along said South line of Section 6 and
74	along said municipal boundary to the POINT OF
75	BEGINNING.

77	Section 2.  The present corporate limits of the City of
78	Lauderhill, Broward County, are hereby extended and enlarged so
79	as to voluntarily annex and include, in addition to the
80	territory presently within its corporate limits, the area
81	consisting of a portion of the right-of-way on N.W. 31st Avenue
82	from the City of Fort Lauderdale, particularly described as
83	follows:

85	A portion of Section 31, Township 49 South, Range 42
86	East being more particularly described as follows:

88	BEGINNING at the intersection of the South right-of-
89	way line of NW 19 Street and the West right-of-way
90	line of NW 31 Avenue, said point being on the
91	municipal boundary of the City of Fort Lauderdale, as
92	established by Chapter 69-1057, Laws of Florida and on
93	the municipal boundary of the City of Lauderhill as
94	established by Ordinance 040-10-220 of the City of
95	Lauderhill;

97	Thence Southerly on said municipal boundaries of the
98	City of Lauderhill and the City of Fort Lauderdale and
99	on said West right-of-way line of NW 31 Avenue, to the
100	intersection with the South line of the North One-Half
101	(N 1/2) of the North One-Half (N 1/2) of the Southeast
102	One-Quarter (SE 1/4) of said Section 31, Township 49
103	South, Range 42 East;

105	Thence Easterly on said municipal boundaries of the
106	City of Lauderhill and the City of Fort Lauderdale and
107	on said South line to the East line of said Section

112	said South right-of-way line of NW 19 Street;

118	Section 3.  In order to remedy the creation of an enclave,
119	the present corporate limits of the City of Lauderhill, Broward
120	County, are hereby contracted so as to deannex and exclude from
121	the territory presently within its corporate limits a small
122	portion of the right-of-way on Sunrise Boulevard and N.W. 31st
123	Avenue that was erroneously annexed into the City of Lauderhill,
124	particularly described as follows:

126	A portion of the North 1/2 of Government Lot 1,
127	Section 6 of Township 50 South, Range 42 East being
128	more particularly described as follows:

130	BEGINNING at the Northeast corner of the Northeast
131	One-Quarter (NE 1/4) of said Section 6, Township 50
132	South, Range 42 East, said point being on the
133	corporate city limits of the City of Lauderhill as
134	established by Ordinance No. 040-10-219 of the City of
135	Lauderhill;

137	Thence Southerly on said municipal boundary and on the
138	East line of said Section 6 to a point on the
139	municipal boundary of the City of Lauderhill as
140	established by Ordinance No. 04-10-217 of the City of
141	Lauderhill;

143	Thence Westerly on said municipal boundary and on the
144	Easterly prolongation of the North line of Parcel 'A',
145	as shown by the plat of THUNDERBIRD SWAP SHOP III, as
146	recorded in Plat Book 142, Page 20 of the Public
147	Records of Broward County, Florida, to a point on the
148	West right-of-way line of NW 31st Avenue, said point
149	being on the municipal boundary of the City of
150	Lauderhill as established by Ordinance No. 040-10-219
151	of the City of Lauderhill;

154	said West right-of-way line of NW 31st Avenue to the
155	South right-of-way line of Sunrise Boulevard;

157	Thence Northwesterly and Westerly on said municipal
158	boundary and on said South right-of-way line of
159	Sunrise Boulevard to the intersection with the
160	Northerly prolongation of the East line of Parcel 'A',
161	as shown by said plat of THUNDERBIRD SWAP SHOP III;

163	Thence North on said Northerly prolongation of the
164	East line of Parcel 'A' to the intersection with the
165	North line of said Section 6, also being the North
166	line of said Government Lot 1;

168	Thence Easterly on said North line to the Northeast
169	corner of the Northeast One-Quarter (NE 1/4) of said
170	Section 6, said point also being the POINT OF
171	BEGINNING.

173	Section 4.  The subject public roads and the public rights-
174	of-way associated therewith, on the Broward County road system
175	(N.W. 31st Avenue), lying within the limits of the lands subject
176	to annexation herein, are transferred from Broward County
177	jurisdiction to the jurisdiction of the annexing municipality
178	solely for the purposes of police and emergency services upon
179	the effective date of the annexation. The responsibility for
180	police and emergency services shall be transferred to the
181	annexing municipality upon the effective date of the annexation.
182	No ownership, operation, maintenance, planning, design, or
183	construction of said roads or rights-of-way shall transfer from
184	Broward County or the Department of Transportation to any
185	municipality.
186	Section 5.  On the effective date of this act, the annexing
187	municipality shall be responsible for and embodied with all
188	municipal powers granted in chapter 166, Florida Statutes, and
189	as otherwise provided by law, including, but not limited to,
190	police and emergency service powers, over the territory hereby
191	annexed.
192	Section 6.  Nothing in this act shall be construed to
193	affect or abrogate the rights of parties to any contracts,
194	whether the same be between Broward County and a third party or
195	between nongovernmental entities, which contracts are in effect
196	prior to the effective date of the annexation.
197	Section 7.  This act shall take effect upon becoming a law.
