A bill to be entitled
2An act relating to financial assistance for contaminated
3petroleum storage sites; amending s. 376.30715, F.S.;
4defining the term "acquired"; providing for financial
5assistance in certain additional circumstances involving
6the transfer of a contaminated property; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 376.30715, Florida Statutes, is amended
12to read:
13     376.30715  Innocent victim petroleum storage system
14restoration.--A contaminated site acquired by the current owner
15prior to July 1, 1990, which has ceased operating as a petroleum
16storage or retail business prior to January 1, 1985, is eligible
17for financial assistance pursuant to s. 376.305(6),
18notwithstanding s. 376.305(6)(a). For purposes of this section,
19the term "acquired" means the acquisition of title to the
20property; however, a subsequent transfer of the property to a
21spouse, a surviving spouse in trust or free of trust, or a
22revocable trust created for the benefit of the settlor does not
23disqualify the site from financial assistance pursuant to s.
24376.3071(5). Eligible sites shall be ranked in accordance with
25s. 376.3071(5).
26     Section 2.  This act shall take effect July 1, 2008.
