A bill to be entitled
2An act relating to certificate-of-need exemptions;
3amending s. 408.036, F.S.; providing an exemption from
4certificate-of-need requirements for certain teaching
5hospitals; providing criteria for qualifying for the
6exemption; limiting the number of projects at specified
7universities eligible to receive letters of exemption;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (u) is added to subsection (3) of
13section 408.036, Florida Statutes, to read:
14     408.036  Projects subject to review; exemptions.--
15     (3)  EXEMPTIONS.--Upon request, the following projects are
16subject to exemption from the provisions of subsection (1):
17     (u)  For the establishment of a teaching hospital, with a
18maximum of 200 beds, on the main campus of a state university
19with an accredited medical school exhibiting activity in the
20area of graduate medical education as reflected by at least
21seven different graduate medical education programs accredited
22by the Accreditation Council of Graduate Medical Education and
23the presence of 100 or more full-time equivalent resident
24physicians. A project described by this paragraph is entitled to
25immediately receive a letter of exemption upon filing for it,
26and a state university with an accredited medical school may not
27receive a letter of exemption for more than one project
28described by this paragraph.
29     Section 2.  This act shall take effect July 1, 2008.
