5 | (12) Notwithstanding the provisions of subsections (1)- |
6 | (8), the commission shall dismiss any complaint when: |
7 | (a) The complaining party filed a parallel complaint, |
8 | arising out of a common nucleus of operative facts, with a |
9 | county ethics commission which resulted in a finding of no |
10 | probable cause or a final order disposing of the complaint; |
11 | (b) The state law upon which the Commission on Ethics |
12 | complaint is based is not materially different from the |
13 | provisions of the county or municipal ordinance applied by the |
14 | county ethics commission when resolving the parallel complaint; |
15 | and |
16 | (c) The proceedings before the county ethics commission |
17 | regarding the parallel complaint were full and fair. |

19 | A county ethics commission also shall dismiss any complaint |
20 | that meets the three criteria in this subsection. |
