7 | 112.313 Standards of conduct for public officers, |
8 | employees of agencies, and local government attorneys.-- |
9 | (2) SOLICITATION OR ACCEPTANCE OF GIFTS OR |
10 | CONTRIBUTIONS.-- |
11 | (a) No public officer, employee of an agency, local |
12 | government attorney, or candidate for nomination or election |
13 | shall solicit or accept anything of value to the recipient, |
14 | including a gift, loan, reward, promise of future employment, |
15 | favor, or service, based upon any understanding that the vote, |
16 | official action, or judgment of the public officer, employee, |
17 | local government attorney, or candidate would be influenced |
18 | thereby. |
19 | (b) No elected or appointed member of a local government |
20 | council or advisory committee acting in a quasi-judicial matter, |
21 | including, but not limited to, code enforcement, zoning, or land |
22 | use decisions, shall, directly or indirectly, solicit any |
23 | contribution on behalf of a candidate from an individual who is |
24 | participating in a matter pending before the council or advisory |
25 | committee. For purposes of this paragraph, "matter" means |
26 | any quasi-judicial or other proceeding, application, request for |
27 | a ruling or other determination, or other particular action |
28 | involving a specific party or parties. This prohibition shall |
29 | not apply to the governing body of a district, county, or |
30 | municipality. |
