A bill to be entitled
2An act relating to public school physical education;
3amending s. 1003.455, F.S.; requiring specified physical
4education instruction for students in kindergarten through
5grade 5 and for certain grade 6 students; providing an
6appropriation for middle school students enrolled in
7certain physical education courses; providing an effective
8date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (3) of section 1003.455, Florida
13Statutes, is amended to read:
14     1003.455  Physical education; assessment.--
15     (3)  Each district school board shall provide 150 minutes
16of at least 30 consecutive minutes per day of physical education
17instruction each week for students in kindergarten through grade
185 and for students in grade 6 who are enrolled in a school that
19contains one or more elementary grades. Students enrolled in
20such instruction shall be reported through the periodic student
21membership surveys, and records of such enrollment shall be
22audited pursuant to s. 1010.305. Such instruction may be
23provided by any instructional personnel as defined in s.
241012.01(2), regardless of certification, who are designated by
25the school principal. Each district school board is encouraged
26to provide 225 minutes of physical education each week for
27students in grades 6 through 8.
28     Section 2.  The sum of $100,000,000 is appropriated from
29the General Revenue Fund within the Florida Education Finance
30Program to the Department of Education to provide a value of
310.05 full-time equivalent student membership for each student
32enrolled in grades 6 through 8 who is also enrolled in a public
33school physical education course of at least 45 minutes per day.
34Such value shall be added to the total full-time equivalent
35student membership in basic programs for grades 6 through 8.
36Each school district must allocate the funds generated through
37this cost factor to the school that generated the funds. If the
38appropriation is insufficient to fully fund the total
39calculation, the appropriation shall be prorated.
40     Section 3.  This act shall take effect July 1, 2008.
