An act relating to trust funds; creating the Florida

Gaming Trust Fund within the Department of Gaming Control;

4

providing the sources and purpose of the trust fund;

5

requiring funds to remain in the trust fund at the end of

6

each fiscal year; providing for future review and

7

termination or re-creation of the trust fund; providing a

8

contingent effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. Florida Gaming Trust Fund.--

13

     (1) There is created the Florida Gaming Trust Fund within

14

the Department of Gaming Control. Moneys deposited in the fund

15

shall be those collected from sources designated by state law.

The purpose of the trust fund is to provide funding for the

17

regulation of skill-based machine gaming and slot machine gaming.

18

     (2) Notwithstanding s. 216.301, Florida Statutes, and

19

pursuant to s. 216.351, Florida Statutes, any balance in the

20

trust fund at the end of any fiscal year shall remain in the

21

trust fund at the end of the fiscal year and shall be available

22

for carrying out the purposes of the trust fund.

     (3) In accordance with s. 19(f)(2), Art. III of the State

24

Constitution, the trust fund must, unless terminated sooner, be

25

terminated on July 1, 2012. Before its scheduled termination, the

26

trust fund must be reviewed as provided in s. 215.3206(1) and

27

(2), Florida Statutes.

     Section 2.  This act shall take effect July 1, 2008, if SB

29

____, or similar legislation creating the Florida Gaming

30

Commission and the Department of Gaming Control, is adopted in

31

the same legislative session or an extension thereof and becomes

32

law.
