2An act relating to the Reduced Cigarette Ignition
3Propensity Standard and Firefighter Protection Act Fund;
4amending s. 633.042, F.S.; creating the Reduced Cigarette
5Ignition Propensity Standard and Firefighter Protection
6Act Fund; providing for source of moneys and purposes;
7providing for annual carryforward of unused funds;
8providing for future review and termination or re-creation
9of the fund; providing a contingent effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsections (10) and (11) of section 633.042,
14Florida Statutes, are renumbered as subsections (11) and (12),
15respectively, and a new subsection (10) is added to that section
16to read:
17     633.042  Reduced Cigarette Ignition Propensity Standard and
18Firefighter Protection Act.--
19     (10)  REDUCED CIGARETTE IGNITION PROPENSITY STANDARD AND
20FIREFIGHTER PROTECTION ACT FUND.--
21     (a)  There is created the Reduced Cigarette Ignition
22Propensity Standard and Firefighter Protection Act Fund. The
23fund shall consist of all moneys recovered as penalties under
24subsection (7). The moneys shall be deposited to the credit of
25the fund and shall, in addition to any other moneys made
26available for such purpose, be made available to the division to
27support firesafety and fire prevention programs.
28     (b)  Notwithstanding the provisions of s. 216.301 and
29pursuant to s. 216.351, any balance in the fund at the end of
30any fiscal year shall remain in the fund at the end of the year
31and shall be available for carrying out the purposes of the
32fund.
33     (c)  In accordance with s. 19(f)(2), Art. III of the State
34Constitution the fund shall be terminated on January 1, 2014,
35unless terminated sooner. Before its scheduled termination, the
36fund shall be reviewed as provided in s. 215.3206(1) and (2).
37     Section 2.  This act shall take effect January 1, 2010, if
38House Bill 1167 or substantially similar legislation is adopted
39in the same legislative session or an extension thereof and
40becomes law.
