11 | Be It Enacted by the Legislature of the State of Florida: |

13 | Section 1. Subsections (10) and (11) of section 633.042, |
14 | Florida Statutes, are renumbered as subsections (11) and (12), |
15 | respectively, and a new subsection (10) is added to that section |
16 | to read: |
17 | 633.042 Reduced Cigarette Ignition Propensity Standard and |
18 | Firefighter Protection Act.-- |
19 | (10) REDUCED CIGARETTE IGNITION PROPENSITY STANDARD AND |
20 | FIREFIGHTER PROTECTION ACT FUND.-- |
21 | (a) There is created the Reduced Cigarette Ignition |
22 | Propensity Standard and Firefighter Protection Act Fund. The |
23 | fund shall consist of all moneys recovered as penalties under |
24 | subsection (7). The moneys shall be deposited to the credit of |
25 | the fund and shall, in addition to any other moneys made |
26 | available for such purpose, be made available to the division to |
27 | support firesafety and fire prevention programs. |
28 | (b) Notwithstanding the provisions of s. 216.301 and |
29 | pursuant to s. 216.351, any balance in the fund at the end of |
30 | any fiscal year shall remain in the fund at the end of the year |
31 | and shall be available for carrying out the purposes of the |
32 | fund. |
33 | (c) In accordance with s. 19(f)(2), Art. III of the State |
34 | Constitution the fund shall be terminated on January 1, 2014, |
35 | unless terminated sooner. Before its scheduled termination, the |
36 | fund shall be reviewed as provided in s. 215.3206(1) and (2). |
37 | Section 2. This act shall take effect January 1, 2010, if |
38 | House Bill 1167 or substantially similar legislation is adopted |
39 | in the same legislative session or an extension thereof and |
40 | becomes law. |
