A bill to be entitled
2An act relating to the Reduced Cigarette Ignition
3Propensity Standard and Firefighter Protection Act
4Enforcement Fund; amending s. 633.042, F.S.; creating the
5Reduced Cigarette Ignition Propensity Standard and
6Firefighter Protection Act Enforcement Fund; providing for
7source of moneys and purposes; providing for annual
8carryforward of unused funds; providing for future review
9and termination or re-creation of the fund; providing a
10contingent effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Paragraph (f) of subsection (5) of section
15633.042, Florida Statutes, is redesignated as paragraph (g), and
16a new paragraph (f) is added to that subsection to read:
17     633.042  Reduced Cigarette Ignition Propensity Standard and
18Firefighter Protection Act.--
19     (5)  CERTIFICATION AND PRODUCT CHANGE.--
20     (f)1.  There is created in the State Treasury a separate,
21nonlapsing fund to be known as the "Reduced Cigarette Ignition
22Propensity Standard and Firefighter Protection Act Enforcement
23Fund." The fund shall consist of all certification fees
24submitted by manufacturers and shall, in addition to any other
25funds made available for such purpose, be available to the
26division solely to support processing, testing, enforcement, and
27oversight activities required by this section.
28     2.  Notwithstanding the provisions of s. 216.301 and
29pursuant to s. 216.351, any balance in the fund at the end of
30any fiscal year shall remain in the fund at the end of the year
31and shall be available for carrying out the purposes of the
32fund.
33     3.  In accordance with s. 19(f)(2), Art. III of the State
34Constitution the fund shall be terminated on January 1, 2014,
35unless terminated sooner. Before its scheduled termination, the
36fund shall be reviewed as provided in s. 215.3206(1) and (2).
37     Section 2.  This act shall take effect January 1, 2010, if
38House Bill 1167 or substantially similar legislation is adopted
39in the same legislative session or an extension thereof and
40becomes law.
