An act relating to emergency medicine; amending ss.

458.3312 and 459.0152, F.S.; prohibiting physicians and

4

osteopathic physicians from holding themselves out as

5

board-certified emergency physicians unless they meet

6

specified requirements; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

9

     Section 1.  Section 458.3312, Florida Statutes, is amended

11

to read:

12

     458.3312  Specialties.--A physician licensed under this

13

chapter may not hold himself or herself out as a board-certified

14

specialist unless the physician has received formal recognition

15

as a specialist from a specialty board of the American Board of

16

Medical Specialties or other recognizing agency approved by the

17

board. A physician licensed under this chapter who completes his

18

or her board certification after January 1, 2009, may not hold

19

himself or herself out as a board-certified emergency physician

20

unless the physician has received formal recognition as a

21

specialist from the American Board of Medical Specialties or

22

other recognizing agency approved by the board and has completed

23

a residency or fellowship training program in emergency medicine

24

which is approved by the Accreditation Council for Graduate

25

Medical Education or the American Osteopathic Association.

26

However, a physician may indicate the services offered and may

27

state that his or her practice is limited to one or more types of

28

services if when this accurately reflects the scope of practice

29

of the physician.

     Section 2.  Section 459.0152, Florida Statutes, is amended

31

to read:

     459.0152  Specialties.--An osteopathic physician licensed

33

under this chapter may not hold himself or herself out as a

34

board-certified specialist unless the osteopathic physician has

35

successfully completed the requirements for certification by the

36

American Osteopathic Association or the Accreditation Council on

37

Graduate Medical Education and is certified as a specialist by a

38

certifying agency approved by the board. An osteopathic physician

39

licensed under this chapter who completes his or her board

40

certification after January 1, 2009, may not hold himself or

41

herself out as a board-certified emergency osteopathic physician

42

unless the osteopathic physician has received formal recognition

43

as a specialist from a recognized agency approved by the board

44

and has completed a residency training program in emergency

45

medicine which is approved by the American Osteopathic

46

Association or the American Council for Graduate Medical

47

Education. However, an osteopathic physician may indicate the

48

services offered and may state that his or her practice is

49

limited to one or more types of services if when this accurately

50

reflects the scope of practice of the osteopathic physician.

51

     Section 3.  This act shall take effect July 1, 2008.
