An act relating to motor vehicle sales warranties;

amending s. 681.102, F.S.; defining the term "motorcycle;"

providing that the provisions of the Motor Vehicle
5
Warranty Enforcement Act apply to motorcycles; providing
6
an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Subsection (15) of section 681.102, Florida
11
Statutes, is amended, present subsections (16) through (23) of
12
that section are redesignated as subsections (17) through (24),
13
respectively, and a new subsection (16) is added to that section,
14
to read:

681.102 Definitions.--As used in this chapter, the term:

(15) "Motor vehicle" means a new vehicle, propelled by
17
power other than muscular power, which is sold in this state to
18
transport persons or property, and includes a motorcycle, a
19
recreational vehicle, or a vehicle used as a demonstrator or
20
leased vehicle if a manufacturer's warranty was issued as a
21
condition of sale, or the lessee is responsible for repairs, but
22
does not include vehicles run only upon tracks, off-road
23
vehicles, trucks over 10,000 pounds gross vehicle weight,
24
motorcycles, mopeds, or the living facilities of recreational
25
vehicles. "Living facilities of recreational vehicles" are those
26
portions designed, used, or maintained primarily as living
27
quarters and include, but are not limited to, the flooring,
28
plumbing system and fixtures, roof air conditioner, furnace,
29
generator, electrical systems other than automotive circuits, the
30
side entrance door, exterior compartments, and windows other than
31
the windshield and driver and front passenger windows.

(16) "Motorcycle" means any motor vehicle having a seat or
33
saddle for the use of the rider and designed to travel on not
34
more than three wheels in contact with the ground, but excluding
35
a tractor or a moped.

Section 2. This act shall take effect July 1, 2008.
