3     Amendment (with title amendment)
4     Remove lines 28-84 and insert:
5     (a)  For purposes of meeting the federal cost neutrality
6requirement of 7 C.F.R. part 246, shall compare the average cost
7of each food item redeemed by above-50-percent vendors against
8the average cost of the same food item redeemed by regular
9vendors.
10     (b)  May not discontinue a WIC-eligible generic product
11unless the product no longer meets the nutritional guidelines of
12the WIC program.
13     (c)  Shall only expend funds provided by the Federal
14Government for the administration of the program. In the event
15the department exceeds the federal funding allocation, the
16department may submit a budget amendment to the Executive Office
17of the Governor requesting additional trust fund authority to
18implement the program pursuant to s. 216.181(11).
19     Section 2.  Section 409.942, Florida Statutes, is amended
20to read:
21     409.942  Electronic benefit transfer program.--
22     (1)  The Department of Children and Family Services shall
23establish an electronic benefit transfer program for the
24dissemination of food stamp benefits and temporary assistance
25payments, including refugee cash assistance payments, asylum
26applicant payments, and child support disregard payments. If the
27Federal Government does not enact legislation or regulations
28providing for dissemination of supplemental security income by
29electronic benefit transfer, the state may include supplemental
30security income in the electronic benefit transfer program.
31     (a)(2)  The department shall, in accordance with applicable
32federal laws and regulations, develop minimum program
33requirements and other policy initiatives for the electronic
34benefit transfer program.
35     (b)(3)  The department shall enter into public-private
36contracts for all provisions of electronic transfer of public
37assistance benefits.
38     (2)(4)  Workforce Florida, Inc., through the Agency for
39Workforce Innovation, shall establish an electronic benefit
40transfer program for the use and management of education,
41training, child care, transportation, and other program benefits
42under its direction. The workforce electronic benefit transfer
43program shall fulfill all federal and state requirements for
44Individual Training Accounts, Retention Incentive Training
45Accounts, Individual Development Accounts, and Individual
46Services Accounts. The workforce electronic benefit transfer
47program shall be designed to enable an individual who receives
48an electronic benefit transfer card under subsection (1) to use
49that card for purposes of benefits provided under the workforce
50development system as well. The Department of Children and
51Family Services shall assist Workforce Florida, Inc., in
52developing an electronic benefit transfer program for the
53workforce development system that is fully compatible with the
54department's electronic benefit transfer program. The agency
55shall reimburse the department for all costs incurred in
56providing such assistance and shall pay all costs for the
57development of the workforce electronic benefit transfer
58program.
59     (3)  By January 1, 2009, the Department of Health shall
60submit a plan for approval by the United States Department of
61Agriculture, Bureau of Food and Nutrition Service, for the
62implementation of a statewide electronic benefits transfer
63program for the dissemination of benefits under the Special
64Supplemental Nutrition Program for Women, Infants, and Children
65(WIC), authorized by the Child Nutrition Act. The plan shall be
66developed in consultation with authorized WIC vendors, including
67above-50-percent vendors. By July 1, 2010, the Department of
