A bill to be entitled
2An act relating to trust funds; creating the Lead
3Poisoning Prevention Trust Fund within the Department of
4Health; providing for a source of funds and purposes of
5the trust fund; providing for an annual carryforward of
6funds; providing for future review and termination or re-
7creation of the trust fund; providing a contingent
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  (1)  The Lead Poisoning Prevention Trust Fund
13is created within the Department of Health. Funds credited to
14the trust fund shall consist of fees generated from examinations
15and certification required under the Florida Lead-based Paint
16Reduction Program pursuant to s. 381.99, Florida Statutes.
17     (2)  Notwithstanding s. 216.301, Florida Statutes, and
18pursuant to s. 216.351, Florida Statutes, any balance in the
19trust fund at the end of any fiscal year shall remain in the
20fund and be available for carrying out the purposes of the trust
21fund.
22     (3)  In accordance with s. 19(f)(2), Art. III of the State
23Constitution, the trust fund shall, unless terminated sooner, be
24terminated on July 1, 2012. Before its scheduled termination,
25the trust fund shall be reviewed as provided in s. 215.3206(1)
26and (2), Florida Statutes.
27     Section 2.  This act shall take effect July 1, 2008, if HB
281197 or similar legislation is adopted in the same legislative
29session or an extension thereof and becomes law.
