     (5) An elected or appointed county, municipal, or other

8

local public officer may not vote or participate in any matter

9

that would inure to the officer's special private gain or loss;

10

that the officer knows would inure to the special private gain or

11

loss of any principal by whom he or she is retained or to the

12

parent organization, sibling, or subsidiary of a corporate

13

principal by which he or she is retained, other than an agency as

14

defined in s. 112.312(2); or that he or she knows would inure to

15

the special private gain or loss of a relative or business

16

associate of the public officer. Before a vote is taken, the

17

public officer shall publicly state to the assembly the nature of

18

all of the officer's interests in the matter, and all of the

19

interests in the matter of his or her principals, relatives, or

20

business associates which are known to him or her, on account of

21

which he or she is abstaining from voting or participating and,

22

at the time or vote or within 15 days after the vote, disclose

23

the nature of all of his or her interests and the interests of

24

his or her principals, relatives, or business associates which

25

are known to him or her, as a public record in a memorandum filed

26

with the person responsible for recording the minutes of the

27

meeting, who shall incorporate the memorandum in the minutes.
