2An act relating to Hillsborough County; amending chapter
32001-299, Laws of Florida, relating to the Public
4Transportation Commission; providing for certain national
5criminal history background checks; authorizing the
6issuance of temporary public vehicle driver's licenses;
7providing for an exception to a public driver's license
8requirement; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Paragraphs (ee) and (kk) of subsection (2) of
13section 5 and paragraph (b) of subsection (5) of section 8 of
14chapter 2001-299, Laws of Florida, are amended to read:
15     Section 5.  Commission powers, mandatory and
16discretionary.--
17     (2)  The commission has the power to:
18     (ee)  Request and receive criminal history record
19information for the purpose of screening applicants for
20certificates and public vehicle driver's licenses and pay a fee
21for any such record. Such record information may include a
22national criminal history records check with the Federal Bureau
23of Investigation. The fingerprints may be submitted by the
24commission to the Florida Department of Law Enforcement (FDLE)
25for state processing, and the department shall forward them to
26the Federal Bureau of Investigation for a national criminal
27history records check. All costs associated with transmittal and
28processing shall be borne by the commission, the employer, or
29the person subject to the background check. The FDLE shall
30invoice the commission for the fingerprints submitted each
31month. The commission shall screen background results to
32determine if an applicant meets licensure requirements.
33     (kk)  Issue, or authorize its director, or any interim
34director, to issue and reissue, for good cause and without the
35necessity of notice or public hearing, temporary permits to
36existing certificate holders and temporary public vehicle
37driver's licenses provided that such temporary permits and
38temporary public vehicle driver's licenses shall be issued for a
39period of time not to exceed 7 days. Upon showing of good cause,
40temporary permits or temporary public vehicle driver's licenses
41may be reissued, but shall not be reissued more than four 4
42successive 7-day seven-day periods without commission approval.
43Issuance of a temporary permit or a temporary public vehicle
44driver's license pursuant to the provisions of this section
45shall not in any way be construed as a commitment to issue a
46permanent permit or annual public vehicle driver's license. No
47action taken by the commission, or by the director or any
48interim director if so authorized, shall be construed to estop
49the commission from subsequently denying an application for a
50permanent permit or annual public vehicle driver's license.
51     Section 8.  Public vehicle driver's license.--
52     (5)  Each public vehicle driver's license:
53     (b)  Shall be valid for 1 year and may be renewed annually
54for 1 additional year when the commission finds no criminal or
55traffic violations during the period of the expiring license. If
56the investigation reveals such violations, the license shall not
57be valid for more than 60 days, providing further, however, that
58temporary public vehicle driver's licenses are exempt from this
59paragraph.
60     Section 2.  This act shall take effect upon becoming a law.
