| 3 | District, Monroe County; amending chapter 2002-337, Laws |
| 4 | of Florida; providing that the district is not subject to |
| 5 | local regulations governing discharge of effluent and is |
| 6 | not obligated to obtain licenses, permits, or |
| 7 | authorizations required by local regulating agencies; |
| 8 | requiring the district to provide the county with a notice |
| 9 | of development; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Subsection (6) is added to section 3 of section |
| 14 | 1 of chapter 2002-337, Laws of Florida, to read: |
| 15 | Section 3. District; creation, jurisdiction, and |
| 16 | purpose.-- |
| 17 | (6) The district shall comply with federal and state laws |
| 18 | governing the construction and operation of its systems and the |
| 19 | quality and manner of discharge of effluent but shall not be |
| 20 | subject to local regulation over the quality and manner of |
| 21 | discharge except as provided herein or to the extent that the |
| 22 | district may by agreement with any other public or private body |
| 23 | authorize the same to exercise authority over the projects of |
| 24 | the district. The district shall not be obligated to obtain |
| 25 | licenses, permits, or other authorizations required by local |
| 26 | regulating agencies for development but shall comply with the |
| 27 | substantive regulations, other than permitting, of the |
| 28 | appropriate local agency in effect at the time of district |
| 29 | approval of the final plans for development. The district shall |
| 30 | provide Monroe County with a Notice of Intent to Proceed that |
| 31 | includes a description of any planned development and identifies |
| 32 | the property no later than 30 days prior to the installation or |
| 33 | construction of wastewater infrastructure or related facilities. |
| 34 | Section 2. This act shall take effect upon becoming a law. |
