3 | amending s. 468.304, F.S.; providing that a postsecondary |
4 | academic institution licensed by the Commission for |
5 | Independent Education to offer a general radiologic |
6 | technology program and accredited by the Accrediting |
7 | Bureau of Health Education Schools is an accredited |
8 | postsecondary academic institution for certification |
9 | purposes; providing an effective date. |

11 | Be It Enacted by the Legislature of the State of Florida: |
12 |
|
13 | Section 1. Paragraph (e) of subsection (3) of section |
14 | 468.304, Florida Statutes, is amended to read: |
15 | 468.304 Certification.--The department shall certify any |
16 | applicant who meets the following criteria: |
17 | (3) Submits satisfactory evidence, verified by oath or |
18 | affirmation, that she or he: |
19 | (e)1. Has successfully completed an educational program, |
20 | which program may be established in a hospital licensed pursuant |
21 | to chapter 395 or in an accredited postsecondary academic |
22 | institution which is subject to approval by the department as |
23 | maintaining a satisfactory standard; or |
24 | 2.a. With respect to an applicant for a basic X-ray |
25 | machine operator's certificate, has completed a course of study |
26 | approved by the department with appropriate study material |
27 | provided the applicant by the department; |
28 | b. With respect to an applicant for a basic X-ray machine |
29 | operator-podiatric medicine certificate, has completed a course |
30 | of study approved by the department, provided that such course |
31 | of study shall be limited to that information necessary to |
32 | perform radiographic procedures within the scope of practice of |
33 | a podiatric physician licensed pursuant to chapter 461; |
34 | c. With respect only to an applicant for a general |
35 | radiographer's certificate who is a basic X-ray machine operator |
36 | certificateholder, has completed an educational program or a 2- |
37 | year training program that takes into account the types of |
38 | procedures and level of supervision usually and customarily |
39 | practiced in a hospital, which educational or training program |
40 | complies with the rules of the department; |
41 | d. With respect only to an applicant for a nuclear |
42 | medicine technologist's certificate who is a general |
43 | radiographer certificateholder, has completed an educational |
44 | program or a 2-year training program that takes into account the |
45 | types of procedures and level of supervision usually and |
46 | customarily practiced in a hospital, which educational or |
47 | training program complies with the rules of the department; or |
48 | e. With respect to an applicant for a radiologist |
49 | assistant's certificate who demonstrates to the department that |
50 | he or she holds a current certificate or registration as a |
51 | radiologist assistant granted by the American Registry of |
52 | Radiologic Technologists. |

54 | For the purposes of this paragraph, a postsecondary academic |
55 | institution licensed by the Commission for Independent Education |
56 | to offer a general radiologic technology program and accredited |
57 | by the Accrediting Bureau of Health Education Schools is an |
58 | accredited postsecondary academic institution. |

60 | The department may not certify any applicant who has committed |
61 | an offense that would constitute a violation of any of the |
62 | provisions of s. 468.3101 or the rules adopted thereunder if the |
63 | applicant had been certified by the department at the time of |
64 | the offense. No application for a limited computed tomography |
65 | certificate shall be accepted. All persons holding valid |
66 | computed tomography certificates as of October 1, 1984, are |
67 | subject to the provisions of s. 468.309. |
68 | Section 2. This act shall take effect July 1, 2008. |
