A bill to be entitled
2An act relating to certification of radiologic personnel;
3amending s. 468.304, F.S.; providing that a postsecondary
4academic institution licensed by the Commission for
5Independent Education to offer a general radiologic
6technology program and accredited by the Accrediting
7Bureau of Health Education Schools is an accredited
8postsecondary academic institution for certification
9purposes; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Paragraph (e) of subsection (3) of section
14468.304, Florida Statutes, is amended to read:
15     468.304  Certification.--The department shall certify any
16applicant who meets the following criteria:
17     (3)  Submits satisfactory evidence, verified by oath or
18affirmation, that she or he:
19     (e)1.  Has successfully completed an educational program,
20which program may be established in a hospital licensed pursuant
21to chapter 395 or in an accredited postsecondary academic
22institution which is subject to approval by the department as
23maintaining a satisfactory standard; or
24     2.a.  With respect to an applicant for a basic X-ray
25machine operator's certificate, has completed a course of study
26approved by the department with appropriate study material
27provided the applicant by the department;
28     b.  With respect to an applicant for a basic X-ray machine
29operator-podiatric medicine certificate, has completed a course
30of study approved by the department, provided that such course
31of study shall be limited to that information necessary to
32perform radiographic procedures within the scope of practice of
33a podiatric physician licensed pursuant to chapter 461;
34     c.  With respect only to an applicant for a general
35radiographer's certificate who is a basic X-ray machine operator
36certificateholder, has completed an educational program or a 2-
37year training program that takes into account the types of
38procedures and level of supervision usually and customarily
39practiced in a hospital, which educational or training program
40complies with the rules of the department;
41     d.  With respect only to an applicant for a nuclear
42medicine technologist's certificate who is a general
43radiographer certificateholder, has completed an educational
44program or a 2-year training program that takes into account the
45types of procedures and level of supervision usually and
46customarily practiced in a hospital, which educational or
47training program complies with the rules of the department; or
48     e.  With respect to an applicant for a radiologist
49assistant's certificate who demonstrates to the department that
50he or she holds a current certificate or registration as a
51radiologist assistant granted by the American Registry of
52Radiologic Technologists.

54For the purposes of this paragraph, a postsecondary academic
55institution licensed by the Commission for Independent Education
56to offer a general radiologic technology program and accredited
57by the Accrediting Bureau of Health Education Schools is an
58accredited postsecondary academic institution.

60The department may not certify any applicant who has committed
61an offense that would constitute a violation of any of the
62provisions of s. 468.3101 or the rules adopted thereunder if the
63applicant had been certified by the department at the time of
64the offense. No application for a limited computed tomography
65certificate shall be accepted. All persons holding valid
66computed tomography certificates as of October 1, 1984, are
67subject to the provisions of s. 468.309.
68     Section 2.  This act shall take effect July 1, 2008.
