A bill to be entitled
2An act relating to the immigration status of inmates;
3amending ss. 944.17 and 951.23, F.S.; requiring the
4Department of Corrections and the administrator of each
5county or municipal detention facility to train personnel
6processing inmates in identification of false or
7fraudulent immigration status documentation and other
8indicators of illegal presence in the United States;
9requiring examination of each incoming inmate's
10immigration status; requiring notification of federal
11officials whenever it is suspected that an inmate is not
12in the country legally; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Subsection (9) is added to section 944.17,
17Florida Statutes, to read:
18     944.17  Commitments and classification; transfers.--
19     (9)  The department shall train appropriate personnel
20involved in processing inmates committed to its custody in
21identification of false or fraudulent immigration status
22documentation and other indicators of illegal presence in the
23United States. The department shall examine the immigration
24status of each person committed to its custody and shall notify
25appropriate federal officials whenever it suspects that such a
26person is not legally present in the United States.
27     Section 2.  Subsection (11) is added to section 951.23,
28Florida Statutes, to read:
29     951.23  County and municipal detention facilities;
30definitions; administration; standards and requirements.--
31     (11)  The administrator of each county or municipal
32detention facility shall train appropriate personnel involved in
33processing inmates committed to the custody of that facility in
34identification of false or fraudulent immigration status
35documentation and other indicators of illegal presence in the
36United States. The administrator of each county or municipal
37detention facility shall examine the immigration status of each
38person committed to the custody of that facility and shall
39notify appropriate federal officials whenever it suspects that
40such a person is not legally present in the United States.
41     Section 3.  This act shall take effect July 1, 2008.
