An act relating to legislative authority to ratify

3

compacts and agreements; defining terms; designating the

4

Governor as the official to negotiate and execute compacts

5

and agreements; providing for ratification of compacts and

6

agreements by the Legislature; providing for submission of

7

compacts and agreements to the Legislature and the

8

Secretary of State; providing for submission of compacts

9

and agreements to signatories for review and approval;

10

providing legislative intent that the act is prospective

11

and does not affect any actions and does not apply

12

retroactively; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

15

     Section 1. (1) For purposes of this section:

17

     (a) "Compact" includes, but is not limited to, any

18

interstate compact between the State of Florida and other states,

19

any tribal-state compact between the State of Florida and an

20

Indian tribe in this state, and any subsequent amendments to the

21

compact.

     (b) "Agreement" includes, but is not limited to, any

23

mutual-aid agreement with agencies of other states which is

24

understood to have the status of a compact but is not actually an

25

agreement between states, any similar agreement, or any

26

subsequent amendments to the agreement.

     (2) The Governor is the designated state officer

28

responsible for negotiating and executing, on behalf of the

29

state, compacts and agreements with other states, agencies of

30

other states, or an Indian tribe in this state.

     (3) Any compact or agreement that is entered into by other

32

states, agencies of other states, or an Indian tribe in this

33

state and the Governor pursuant to subsection (2), and that is

34

not codified by the Legislature, must be conditioned upon

35

ratification by the Legislature.

     (4) Following completion of negotiations, the Governor

37

shall submit a copy of any executed compact or agreement for

38

ratification by a majority vote by both houses of the Legislature

39

and shall submit a copy of the executed compact or agreement to

40

the Secretary of State pending receipt of an act ratifying the

41

compact or agreement under the provisions of this section.

42

     (5) Upon receipt of an act ratifying the compact or

43

agreement, the Secretary of State shall forward a copy of the

44

executed compact or agreement and the ratifying act to the

45

signatories to the compact or agreement for review and approval.

46

     Section 2. It is the intent of the Legislature that this

47

act shall apply to actions brought on or after the effective date

48

of this act, is not remedial in nature, and shall not apply

49

retroactively.

     Section 3.  This act shall take effect upon becoming a law.
