An act relating to state lands; amending s. 253.71, F.S.;

eliminating obsolete provisions relating to surcharges for

4

the use of submerged lands; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (a) of subsection (2) of section

9

253.71, Florida Statutes, is amended to read:

10

     253.71  The lease contract.--When the board has determined

11

that the proposed lease is not incompatible with the public

12

interest and that the applicant has demonstrated his or her

13

capacity to perform the operations upon which the application is

14

based, it may proceed to consummate a lease contract having the

15

following features in addition to others deemed desirable by the

16

board:

     (2)  RENTAL FEES.--

18

     (a)  The lease contract shall specify such amount of rental

19

per acre of leased bottom as may be agreed to by the parties and

20

shall take the form of fixed rental to be paid throughout the

21

term of the lease. Beginning January 1, 1990, A surcharge of $10

22

$5 per acre, or any fraction of an acre, per annum shall be

23

levied upon each lease according to the guidelines set forth in

24

s. 597.010(7). Beginning January 1, 2001, the surcharge shall be

25

increased to $10 per acre, or any fraction of an acre, per annum.

     Section 2.  This act shall take effect upon becoming a law.
