Section 8. The Legislature finds that encouragement and
8
promotion of reuse of reclaimed water, as defined by the
9
Department of Environmental Protection, are state objectives and
10
considered to be in the public interest. The Legislature finds
11
that the implementation of this policy has been hampered by a
12
lack of clear understanding concerning the role of local
13
governments that produce and distribute reclaimed water, and
14
water management districts that regulate reclaimed water use. The
15
Legislature finds that the Department of Environmental Protection
16
and water management districts do not have a common policy as to
17
consideration of reclaimed water in the water use permitting and
18
water shortage processes. The Legislature finds that a clear and
19
consistent policy regarding reclaimed water use is required in
20
order to achieve the most efficient and beneficial use of this
21
resource.

(1) The Reclaimed Water Coordination Task Force is created
23
to recommend clear direction concerning the relative roles of
24
local governments and water management districts with regard to
25
the regulation of reclaimed water use and to propose a statewide
26
uniform approach to consideration of reclaimed water use in the
27
water use permitting and water shortage processes. The task force
28
shall review the rules, programs, and policies of the five water
29
management districts relating to consideration of reclaimed water
30
use in water use permitting, water shortages, and related
31
actions, activities, or programs in preparing its
32
recommendations.

(2) The task force shall be composed of the following 17
34
members:
35
(a) The President of the Senate and the Speaker of the
36
House of Representatives shall each appoint a member from their
37
respective chambers, who shall co-chair the task force.
38
(b) The Secretary of Environmental Protection or designee.
39
(c) The Commissioner of Agriculture or designee.
40
(d) The executive director of the South Florida Water
41
Management District or designee.
42
(e) The executive director of the Southwest Florida Water
43
Management District or designee.
44
(f) The eExecutive director of the St. Johns River Water
45
Management District or designee.
46
(g) The executive director of the Florida Nursery Growers
47
and Landscape Association or designee.
48
(h) The executive director of the Florida Sugar Cane League
49
or designee.
50
(i) Two members, one each appointed by the President of
51
the Senate and the Speaker of the House of Representatives, who
52
shall be employees of a local government that produces reclaimed
53
water for reuse by the public, as follows:
54
1. A representative of a not-for-profit environmental
55
advocacy organization; and
56
2. A representative of a company that is a self-supplier of
57
water.

(3) Task force members shall be appointed by August 1,
59
2008.

(4) The clerical and professional staff of the Department
61
of Environmental Protection shall provide administrative support
62
to the task force. The task force may request the clerical and
63
professional staffs of the standing committees of the Senate and
64
the House of Representatives to provide such support, if the task
65
force finds it appropriate to do so.

(5) The task force shall:

(a) Determine how reclaimed water use should be taken into
68
account in the water use permitting and water shortage processes.
69
(b) Assess the proper roles of local governments and water
70
management districts in regulating reclaimed water use.

(c) Consider how the reuse of reclaimed water could be
72
promoted in areas where new or increased water withdrawals have
73
been limited by law through the use of offsets or other similar
74
incentives.
75
(d) Evaluate how to best supplement reclaimed water
76
supplies during peak demands periods in order to improve
77
reliability and promote widespread adoption of this resource.
78
(e) Consider how to best incorporate any recommended policy
79
changes in a unified approach that is applicable statewide.

(6) While the task force deliberates, the Department of
81
Environmental Protection and the water management districts shall
82
encourage the use of pilot projects for the purpose of obtaining
83
data and operating experience through the use of various types of
84
reuse and irrigation systems.

(7) The task force shall submit a report to the Governor,
86
the President of the Senate, and the Speaker of the House of
87
Representatives which summarizes its findings and recommendations
88
by January 31, 2009.

(8) The Department of Environmental Protection and the
90
water management districts are directed, and all other agencies
91
and local governments are requested, to render assistance to and
92
cooperate with the task force.
93
(9) Members shall serve without compensation. Members are
94
entitled to reimbursement for per diem and travel expenses as
95
provided in s. 112.061, Florida Statutes.

(10) The task force is disolved on January 31, 2009.
