An act relating to environmental regulation; amending s.

403.8163, F.S.; removing an obsolete reference to the

Division of Beaches and Shores of the Department of

5

Environmental Protection; authorizing the department to

6

determine that spoil from maintenance dredge operations

7

may be placed into a beach or dune system; providing an

8

effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 403.8163, Florida Statutes, is amended

13

to read:

14

     403.8163  Sites for disposal of spoil from maintenance

15

dredge operations; selection.--Lands created by spoil or used as

16

dredge spoil sites must be given priority consideration as sites

17

for disposal of spoil in maintenance dredge operations, except

18

when the Division of Beaches and Shores of the Department of

19

Environmental Protection determines that the spoil, or some

20

substantial portion thereof, may be placed as compatible sediment

21

into the littoral system of an adjacent sandy beach or coastal

22

barrier dune system for the preservation and protection of such

23

beach or dune system.

     Section 2.  This act shall take effect upon becoming a law.
