A bill to be entitled

An act relating to paintball guns and markers; defining
3
the terms "paintball gun" and "paintball marker";
4
prohibiting a person from carrying a paintball gun or
5
paintball marker in a vehicle on the highway; providing
6
specified exceptions; providing that the act does not
7
apply to a commercial paintball field, range, or course
8
when passengers are transported to and from designated
9
player areas; providing that a violation of the act is a
10
first-degree misdemeanor; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Paintball guns and paintball markers.--
15
(1) As used in this section, the term "paintball gun" or
16
"paintball marker" means a device designed and manufactured to
17
propel, by gas or air, an encapsulated gelatin paintball.

(2) Except as set forth in subsection (3), a person may not
19
carry a paintball gun or paintball marker in a vehicle on the
20
highway unless:

(a) The paintball gun or paintball marker is disassembled
22
so that the propellant canister is separate from the rest of the
23
device and the device is empty of encapsulated gelatin
24
paintballs; or
25
(b) The propellant canister of the paintball gun or
26
paintball marker has been emptied of its gas or air propellant
27
and the device is empty of encapsulated gelatin paintballs.

(3) Subsection (2) does not apply to a commercial paintball
29
field, range, or course when passengers are being transported in
30
a vehicle by an employee of the commercial field, range, or
31
course to and from designated player areas.

(4) A person who violates this section commits a
33
misdemeanor of the first degree, punishable as provided in s.
35
Section 2. This act shall take effect July 1, 2008.
