     Section 2.  Subsection (3) of section 400.464, Florida

8

Statutes, is amended to read:

     400.464  Home health agencies to be licensed; expiration of

10

license; exemptions; unlawful acts; penalties.--

11

     (3) A Any home infusion therapy provider must shall be

12

licensed as a home health agency or nurse registry. A Any

13

infusion therapy provider currently authorized to receive

14

Medicare reimbursement under a DME - Part B Provider number for

15

the provision of infusion therapy must shall be licensed as a

16

noncertified home health agency. Such a provider shall continue

17

to receive that specified Medicare reimbursement without being

18

certified so long as the reimbursement is limited to those items

19

authorized pursuant to the DME - Part B Provider Agreement and

20

the agency is licensed in compliance with the other provisions

21

of this part.
