     Delete line(s) 26-33

and insert:

United States Environmental Protection Agency. A local

8

government may impose a stormwater management fee or assessment

9

on lands classified as agricultural pursuant to s. 193.461

10

provided the agricultural lands contribute to municipal separate

11

stormwater system permitted facilities and credits against the

12

cost of the fees or assessments are provided according to the

13

amount of water quality treatment and water quantity management

14

achieved by best management practices implemented according to

15

rules adopted by the Department of Agriculture and Consumer

16

Services or a water management district. The amount of credit

17

shall be determined by the local government after consultation

18

with the Department of Agriculture and Consumer Services.

However, a local government shall not impose a stormwater

20

management fee or assessment on agricultural lands used for

21

forestry or unimproved pasture or on such agricultural lands

22

where activities are governed by an agricultural discharge permit

23

or environmental resource permit which specifically addresses the

24

stormwater management requirements of the municipal separate

25

stormwater system permit.
