An act relating to private property rights; prohibiting

certain restrictions that prevent a property owner from

4

flying a United States flag from a flagpole that does not

5

exceed 20 feet in height; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. Notwithstanding the provisions of ss. 720.304(2)

10

and 720.3075(3), Florida Statutes, a homeowners' association,

11

management company, or other entity may not prohibit a person

12

from flying a United States flag on that person's property from a

13

flagpole that does not exceed 20 feet in height.

     Section 2.  This act shall take effect July 1, 2008.
