A bill to be entitled
2An act relating to trust funds; creating the Florida
3Gaming Trust Fund within the Department of Gaming Control;
4providing the sources and purpose of the trust fund;
5requiring funds to remain in the trust fund at the end of
6each fiscal year; providing for future review and
7termination or re-creation of the trust fund; providing a
8contingent effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Florida Gaming Trust Fund.--
13     (1)  There is created the Florida Gaming Trust Fund within
14the Department of Gaming Control. Moneys deposited in the fund
15shall be those collected from sources designated by state law.
16The purpose of the trust fund is to provide funding for the
17regulation of skill-based machine gaming and slot machine
18gaming.
19     (2)  Notwithstanding s. 216.301, Florida Statutes, and
20pursuant to s. 216.351, Florida Statutes, any balance in the
21trust fund at the end of any fiscal year shall remain in the
22trust fund at the end of the fiscal year and shall be available
23for carrying out the purposes of the trust fund.
24     (3)  In accordance with s. 19(f)(2), Art. III of the State
25Constitution, the trust fund must, unless terminated sooner, be
26terminated on July 1, 2012. Before its scheduled termination,
27the trust fund must be reviewed as provided in s. 215.3206(1)
28and (2), Florida Statutes.
29     Section 2.  This act shall take effect July 1, 2008, if HB
301385, or similar legislation creating the Florida Gaming
31Commission and the Department of Gaming Control, is adopted in
32the same legislative session or an extension thereof and becomes
33law.
