4 | Remove lines 1865-1879 and insert: |
5 | (4)(a)(5) When bonds are outstanding which have been |
6 | issued to finance or refinance any turnpike project, the tolls |
7 | and all other revenues derived from the turnpike system and |
8 | pledged to such bonds shall be set aside as may be provided in |
9 | the resolution authorizing the issuance of such bonds or the |
10 | trust agreement securing the same. The tolls or other revenues |
11 | or other moneys so pledged and thereafter received by the |
12 | department are immediately subject to the lien of such pledge |
13 | without any physical delivery thereof or further act. The lien |
14 | of any such pledge is valid and binding as against all parties |
15 | having claims of any kind in tort or contract or otherwise |
16 | against the department irrespective of whether such parties have |
17 | notice thereof. Neither the resolution nor any trust agreement |
18 | by which a pledge is created need be filed or recorded except in |
19 | the records of the department. |
20 | (b) The department shall annually transfer an amount |
21 | equivalent to 2.5 percent of the revenues collected on the |
22 | Homestead Extension of the Florida Turnpike to the Miami-Dade |
23 | Expressway Authority. |
