4 | Remove lines 1865-1879 and insert: |
5 | (4)(a)(5) When bonds are outstanding which have been |
6 | issued to finance or refinance any turnpike project, the tolls |
7 | and all other revenues derived from the turnpike system and |
8 | pledged to such bonds shall be set aside as may be provided in |
9 | the resolution authorizing the issuance of such bonds or the |
10 | trust agreement securing the same. The tolls or other revenues |
11 | or other moneys so pledged and thereafter received by the |
12 | department are immediately subject to the lien of such pledge |
13 | without any physical delivery thereof or further act. The lien |
14 | of any such pledge is valid and binding as against all parties |
15 | having claims of any kind in tort or contract or otherwise |
16 | against the department irrespective of whether such parties have |
17 | notice thereof. Neither the resolution nor any trust agreement |
18 | by which a pledge is created need be filed or recorded except in |
19 | the records of the department. |
20 | (b) Prior to October 1, 2008, the department shall conduct |
21 | a study of the turnpike system users that determines the number |
22 | of vehicles that enter the Bird Road Plaza and then connect onto |
23 | the Miami-Dade Expressway Authority system. No later than March |
24 | 1, 2009, the department shall enter into a revenue-sharing |
25 | agreement with the Miami-Dade Expressway Authority which |
26 | provides for the transfer of 25 percent of the revenues |
27 | equivalent to the amount of revenues generated by the vehicles |
28 | that enter the Bird Road Plaza and then connect onto the Miami- |
29 | Dade Expressway Authority system as determined by the study. The |
30 | agreement shall be updated based on subsequent traffic studies |
31 | conducted at such frequency as agreed to by the department and |
32 | the Miami-Dade Expressway Authority, but in no event shall the |
33 | agreement be updated more frequently that once every 2 years and |
34 | no less frequently than once every 5 years. |
