The Committee on Finance and Tax (Storms) recommended the

following amendment:

     Between line(s) 272 and 273,

insert:

     Section 2.  Paragraph (b) of subsection (6) of section

9

1002.20, Florida Statutes, is amended to read:

10

     1002.20  K-12 student and parent rights.--Parents of public

11

school students must receive accurate and timely information

12

regarding their child's academic progress and must be informed of

13

ways they can help their child to succeed in school. K-12

14

students and their parents are afforded numerous statutory rights

15

including, but not limited to, the following:

16

     (6)  EDUCATIONAL CHOICE.--

17

     (b)  Private school choices.--Parents of public school

18

students may seek private school choice options under certain

19

programs.

20

     1.  Under the Opportunity Scholarship Program, the parent of

21

a student in a failing public school may request and receive an

22

opportunity scholarship for the student to attend a private

23

school in accordance with the provisions of s. 1002.38.

24

     2.  Under the McKay Scholarships for Students with

25

Disabilities Program, the parent of a public school student with

26

a disability who is dissatisfied with the student's progress may

27

request and receive a McKay Scholarship for the student to attend

28

a private school in accordance with the provisions of s. 1002.39.

     3.  Under the corporate income tax credit scholarship

30

program, the parent of a student who qualifies for free or

31

reduced-price school lunch may seek a scholarship from an

32

eligible nonprofit scholarship-funding organization in accordance

33

with the provisions of s. 220.187.

For a child in foster care, the court may enter an order that

36

permits the Department of Children and Family Services or its

37

subcontracted providers to seek a scholarship on behalf of such

38

child pursuant to this section in the absence of parental consent

39

or contrary to a parent's expressed wishes, if doing so is in the

40

best interest of the child or if the child wishes.

amending s. 1002.20, F.S.; authorizing a court to enter an

order that permits the Department of Children and Family

50
