1	A bill to be entitled
2	An act relating to the City of Tallahassee, Leon County;
3	authorizing the Division of Alcoholic Beverages and
4	Tobacco of the Department of Business and Professional
5	Regulation to issue up to a specified number of temporary
6	permits to a nonprofit civic organization to sell
7	alcoholic beverages for consumption on the premises at
8	outdoor events on public right-of-way in the downtown area
9	of Tallahassee; providing that such events require a
10	street-closure permit from the City of Tallahassee;
11	providing that the permits authorized by the act are in
12	addition to certain other authorized temporary permits;
13	requiring the nonprofit civic organization to comply with
14	certain statutory requirements in obtaining the permits
15	authorized by the act; requiring the division to adopt
16	rules; providing an effective date.

18	Be It Enacted by the Legislature of the State of Florida:

20	Section 1.  (1)  Notwithstanding any other provision of
21	law, the Division of Alcoholic Beverages and Tobacco of the
22	Department of Business and Professional Regulation may issue to
23	a bona fide nonprofit civic organization, upon application and
24	presentation of a valid street-closure permit issued by the City
25	of Tallahassee, a temporary permit authorizing the sale of
26	alcoholic beverages for consumption on the premises at outdoor
27	events on public right-of-way in the downtown area of
28	Tallahassee. Any such nonprofit civic organization may be issued
29	up to 15 temporary permits per calendar year, and each temporary
30	permit is valid for up to 3 days. For purposes of this act, the
31	downtown area of Tallahassee is that area beginning at the
32	intersection of Wahnish Way and West Orange Avenue, running
33	north along Wahnish Way, Railroad Avenue, and Macomb Street to
34	West Park Avenue, then east to North Meridian Street, then south
35	to Apalachee Parkway, then east to Suwannee Street, then south
36	to Myers Park Drive, then east to Golf Terrace Drive, then south
37	to East Magnolia Drive, then west to South Meridian Street, then
38	south to East Orange Avenue, then west to the point of beginning
39	at the intersection of Wahnish Way and West Orange Avenue, the
40	total area encompassing approximately 1.5 square miles.
41	(2)  The temporary permits authorized by this act are in
42	addition to the three temporary permits authorized per year for
43	a nonprofit civic organization pursuant to section 561.422,
44	Florida Statutes.
45	(3)  The nonprofit civic organization shall comply with all
46	other requirements of section 561.422, Florida Statutes, in
47	obtaining the temporary permits authorized by this act.
48	(4)  On or before October 1, 2008, the Division of
49	Alcoholic Beverages and Tobacco of the Department of Business
50	and Professional Regulation shall adopt rules pursuant to
51	chapter 120, Florida Statutes, to administer this act. Such
52	rules shall include permitting procedures and application forms.
53	Section 2.  This act shall take effect upon becoming a law.
