An act relating to school food service programs; amending

3

s. 1006.06, F.S.; requiring the expansion of school

4

district breakfast programs to middle and high schools;

5

specifying requirements for the provision of universal

6

free school breakfast; providing procedures for school

7

breakfast programs and requiring information to be

8

communicated to students and parents; authorizing the

9

Department of Education to develop an incentive program to

10

encourage student participation; providing an effective

11

date.

Be It Enacted by the Legislature of the State of Florida:

14

15

     Section 1.  Subsection (5) of section 1006.06, Florida

16

Statutes, is amended to read:

17

     1006.06  School food service programs.--

18

     (5)(a)  Each district school board shall implement school

19

breakfast programs in all elementary schools which shall that

20

make breakfast available to all students in the schools. By the

21

beginning of the 2010-2011 school year, each district school

22

board shall expand its school breakfast programs to make

23

breakfast available to all students in its middle and high

24

schools. kindergarten through grade 6 in each district school,

25

unless the elementary school goes only through grade 5, in which

26

case the requirement shall apply only through grade 5. Each

27

district school board shall implement breakfast programs in all

28

elementary schools in which students are eligible for free and

29

reduced price lunch meals, to the extent specifically funded in

30

the General Appropriations Act.

     (b) By the beginning of the 2010-2011 school year:

32

     1. The district school board shall provide universal free

33

breakfast to all students in each elementary, middle, and high

34

school in which 80 percent or more of students are eligible for

35

free or reduced-price meals, to the extent specifically funded in

36

the General Appropriations Act. In these schools, at least 10

37

percent of the breakfast meals shall be served at an alternative

38

site location which may include, but not be limited to,

39

"breakfast in the classroom," "Grab 'n' Go" breakfast, and

40

"breakfast on the bus."

41

     2. All elementary, middle, and high school students shall:

42

     a. Have permission to visit a breakfast point-of-sale,

43

receive a "Grab 'n' Go" breakfast, and eat the breakfast in the

44

classroom for a period of time of at least 15 minutes after the

45

first bell has rung if the school bus ridden by the student

46

arrives late or for a reasonable period of time that enables the

47

student to eat the breakfast if the school bus arrives after the

48

first bell has rung.

     b. Annually receive information prepared by the district's

50

food service administration regarding the school breakfast

51

program. The information shall be communicated through school

52

announcements and written notice sent to all parents.

53

     (c) A district school board may operate a breakfast program

54

providing for food preparation at the school site or in central

55

locations with distribution to designated satellite schools or

56

any combination thereof.

     (d)(b) The commissioner shall make every reasonable effort

58

to ensure that any school designated a "severe need school"

59

receives the highest rate of reimbursement to which it is

60

entitled pursuant to 42 U.S.C. s. 1773 for each free and reduced

61

price breakfast served.

     (e)(c) The department shall calculate and distribute a

63

school district breakfast supplement for each school year by

64

multiplying the state breakfast rate as specified in the General

65

Appropriations Act by the number of free and reduced price

66

breakfast meals served.

     (f) The department may develop an incentive program for

68

school districts to encourage the expansion of student

69

participation in school breakfast programs through innovative

70

means which may include, but not be limited to, rewarding schools

71

that significantly increase student participation and schools

72

that maintain a 75-percent student participation rate. To the

73

extent specifically funded in the General Appropriations Act,

74

funding shall be given to school districts according to the

75

percentage of students served.

76

     (g)(d) The Legislature shall provide sufficient funds in

77

the General Appropriations Act to reimburse participating school

78

districts for the difference between the average federal

79

reimbursement for free and reduced price breakfasts and the

80

average statewide cost for breakfasts.

81

     Section 2.  This act shall take effect July 1, 2008.
