2An act relating to county lease arrangements; amending s.
3125.031, F.S.; providing an exemption from term limitation
4for leases entered into by a county with another
5governmental entity; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Section 125.031, Florida Statutes, is amended
10to read:
11     125.031  Lease or lease-purchases of property for public
12purposes.--Counties may enter into leases or lease-purchase
13arrangements relating to properties needed for public purposes
14for periods not to exceed 30 years at a stipulated rental to be
15paid from current or other legally available funds and may make
16all other contracts or agreements necessary or convenient to
17carry out such objective. The county shall have the right to
18enter into such leases or lease-purchase arrangements with
19private individuals, other governmental agencies, or
20corporations. When the term of such lease is for longer than 60
21months, the rental shall be payable only from funds arising from
22sources other than ad valorem taxation. Such leases or lease-
23purchase arrangements shall be subject to approval by the board
24of county commissioners, and no such lease or lease-purchase
25contract shall be entered into without said approval.
26Notwithstanding any provision of law to the contrary, a lease
27entered into by a county with another governmental entity as
28authorized under the provisions of s. 125.01 shall not be
29subject to the 30-year lease term limitation of this section.
30     Section 2.  This act shall take effect July 1, 2008.
