8 | public school under certain conditions; providing |
9 | criteria; providing for a public school student to |
10 | participate in interscholastic sports at another public |
11 | school; providing criteria; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |
14 |
|
15 | Section 1. This act may be cited as "Erin's Law." |
16 | Section 2. Paragraph (d) of subsection (3) of section |
17 | 1006.15, Florida Statutes, is amended, and paragraphs (e) and |
18 | (f) are added to that subsection, to read: |
19 | 1006.15 Student standards for participation in |
20 | interscholastic extracurricular student activities; |
21 | regulation.-- |

23 | (d) An individual charter school student pursuant to s. |
24 | 1002.33 is eligible to participate at the public school to which |
25 | the student would be assigned according to district school board |
26 | attendance area policies or which the student could choose to |
27 | attend, pursuant to district or interdistrict controlled open- |
28 | enrollment provisions, in any interscholastic extracurricular |
29 | activity of that school, unless such activity is provided by the |
30 | student's charter school, if the following conditions are met: |
31 | 1. The charter school student must meet the requirements |
32 | of the charter school education program as determined by the |
33 | charter school governing board. |
34 | 2. During the period of participation at a school, the |
35 | charter school student must demonstrate educational progress by |
36 | maintaining the grade point average required by this section and |
37 | passing each class for which he or she is enrolled as required |
38 | in paragraph (b). |
39 | 3. The charter school student must meet the same residency |
40 | requirements as other students in the school at which he or she |
41 | participates. |
42 | 4. The charter school student must meet the same standards |
43 | of acceptance, behavior, and performance that are required of |
44 | other students in extracurricular activities. |
45 | 5. The charter school student must register with the |
46 | school his or her intent to participate in interscholastic |
47 | extracurricular activities as a representative of the school |
48 | before the beginning date of the season for the activity in |
49 | which he or she wishes to participate. A charter school student |
50 | must be able to participate in curricular activities if that is |
51 | a requirement for an extracurricular activity. |
52 | 6. A student who transfers from a charter school program |
53 | to a traditional public school before or during the first |
54 | grading period of the school year is academically eligible to |
55 | participate in interscholastic extracurricular activities during |
56 | the first grading period if the student has a successful |
57 | evaluation from the previous school year, pursuant to |
58 | subparagraph 2. |
59 | 7. Any public school or private school student who has |
60 | been unable to maintain academic eligibility for participation |
61 | in interscholastic extracurricular activities is ineligible to |
62 | participate in such activities as a charter school student until |
63 | the student has successfully completed one grading period in a |
64 | charter school pursuant to subparagraph 2. to become eligible to |
65 | participate as a charter school student. |
66 | (e) A private school student is eligible to participate in |
67 | interscholastic sports at the public school to which the student |
68 | would be assigned according to the district school board's |
69 | attendance area policies or at a public school that the student |
70 | could choose to attend under district or interdistrict |
71 | controlled open enrollment provisions if all of the following |
72 | conditions are met: |
73 | 1. The private school student meets the requirements of |
74 | the private school program pursuant to s. 1002.42. |
75 | 2. The private school in which the student is enrolled |
76 | does not offer the interscholastic sports in which the student |
77 | would participate at the public school. |
78 | 3. During the period of participation at the public |
79 | school, the private school student demonstrates educational |
80 | progress by maintaining the grade point average required by this |
81 | section and passing each class for which he or she is enrolled |
82 | in the private school program as confirmed by a transcript from |
83 | the private school. If the private school student is unable to |
84 | maintain academic eligibility for participating in |
85 | interscholastic sports, the student is ineligible to participate |
86 | in such activities until he or she successfully completes one |
87 | grading period in all subjects taken in the private school |
88 | program. |
89 | 4. The private school student meets the same residency |
90 | requirements as other students in the school at which he or she |
91 | participates. |
92 | 5. The private school student meets the same standards of |
93 | acceptance, behavior, and performance as required of other |
94 | students participating in interscholastic sports at the public |
95 | school. |
96 | 6. The private school student registers with the public |
97 | school his or her intent to participate in interscholastic |
98 | sports as a representative of the school before the beginning |
99 | date of the season for the activity in which he or she wishes to |
100 | participate; however, the private school student must be able to |
101 | participate in curricular activities if that is a requirement |
102 | for interscholastic sports. A student who transfers from a |
103 | private school program to a public school before or during the |
104 | first grading period of the school year is academically eligible |
105 | to participate in interscholastic sports during the first |
106 | grading period if the student meets the requirements of |
107 | subparagraph 3. from the previous school year. |
108 | 7. The private school in which the student is enrolled |
109 | provides an affidavit to the public school which states that the |
110 | private school: |
111 | a. Does not offer the interscholastic sports in which the |
112 | student would participate at the public school; and |
113 | b. Did not offer the interscholastic sports in which the |
114 | student would participate in during the prior academic year. |
115 | (f) A public school student is eligible to participate in |
116 | interscholastic sports at another public school to which the |
117 | student would be assigned according to the district school |
118 | board's attendance area policies or at a public school that the |
119 | student could choose to attend under district controlled open |
120 | enrollment provisions if all of the following conditions are |
121 | met: |
122 | 1. The public school in which the student is enrolled does |
123 | not offer the interscholastic sports in which the student would |
124 | participate at the public school. |
125 | 2. During the period of participation at the school, the |
126 | student demonstrates educational progress as required in |
127 | paragraph (a). |
128 | 3. The public school in which the student is enrolled is |
129 | in the same school district as that in which the student intends |
130 | to participate in the interscholastic sports under this section. |
131 | 4. The student meets the same standards of acceptance, |
132 | behavior, and performance as required of other students in |
133 | interscholastic sports. |
134 | 5. The student registers with the school his or her intent |
135 | to participate in interscholastic sports as a representative of |
136 | the school before the beginning date of the season for the |
137 | activity in which he or she wishes to participate. A student |
138 | must be able to participate in curricular activities if that is |
139 | a requirement for interscholastic sports. |
140 | 6. A student who transfers from the school in which he or |
141 | she is enrolled to another public school before or during the |
142 | first grading period of the school year is academically eligible |
143 | to participate in interscholastic sports during the first |
144 | grading period if the student has a successful evaluation from |
145 | the previous school year pursuant to subparagraph 2. |
146 | 7. Any public school student who has been unable to |
147 | maintain academic eligibility for participation in |
148 | interscholastic sports is ineligible to participate in such |
149 | activities until the student has successfully completed one |
150 | grading period in the student's home school pursuant to |
151 | subparagraph 2. to become eligible to participate. |
152 | Section 3. This act shall take effect July 1, 2008. |
