An act relating to termination of pregnancy; amending s.

390.01114, F.S.; prohibiting a nonresident minor from

petitioning a circuit court in this state for judicial

waiver of notice of termination of pregnancy; providing an

6

effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (a) of subsection (4) of section

11

390.01114, Florida Statutes, is amended to read:

     390.01114  Parental Notice of Abortion Act.--

13

     (4)  PROCEDURE FOR JUDICIAL WAIVER OF NOTICE.--

14

     (a)  A minor may petition any circuit court in a judicial

15

circuit within the jurisdiction of the District Court of Appeal

16

in which she resides for a waiver of the notice requirements of

17

subsection (3) and may participate in proceedings on her own

18

behalf. The petition may be filed under a pseudonym or through

19

the use of initials, as provided by court rule. The petition must

20

include a statement that the petitioner is pregnant and notice

21

has not been waived. The court shall advise the minor that she

22

has a right to court-appointed counsel and shall provide her with

23

counsel upon her request at no cost to the minor. A nonresident

24

minor may not petition any circuit court of this state for a

25

waiver of the notice requirements of subsection (3).

     Section 2.  This act shall take effect upon becoming a law.
