The Committee on Judiciary (Fasano) recommended the following

amendment:

     Senate Amendment (with title amendment)

     Delete everything after the enacting clause

7

and insert:

     Section 1.  Subsection (4) is added to section 83.53,

9

Florida Statutes, to read:

10

83.53  Landlord's access to dwelling unit.--

11

     (4) The landlord shall maintain a written record, subject

12

to inspection by a tenant upon the tenant's request, which

13

includes:

14

     (a) The names of all employees of the landlord who have

15

access to the dwelling unit.

16

     (b) The dates and times that any employee of the landlord

17

has entered the dwelling unit pursuant to this section.

For the purposes of this subsection, the term "employee" means a

20

person who receives compensation from, and is under the

21

supervision and control of, a landlord who regularly deducts the

22

F.I.C.A. and withholding tax and provides workers' compensation,

23

all as prescribed by law.

     (c) This section does not apply to homes for the aged as

25

that term is defined in s. 212.08(7)(i) to the extent that such

26

facilities provide care and services for the aged.

     Section 2.  This act shall take effect July 1, 2008.
