     Section 86. (1) By July 1, 2009, the Agency for Enterprise

7

Information Technology shall define objective standards for:

8

     (a) Measuring data center energy consumption and

9

efficiency, including, but not limited to, airflow and cooling,

10

power consumption and distribution, and environmental control

11

systems in a data center facility; and

12

     (b) Calculating total cost of ownership of energy efficient

13

information technology products, including initial purchase,

14

installation, ongoing operation and maintenance, and disposal

15

costs over the lifecycle of the product.

16

     (2) State data centers and computing facilities designated

17

by the Agency for Enterprise Information Technology shall

18

evaluate their data center facilities for energy efficiency using

19

the standards established in this section.

20

     (a) Results of these evaluations shall be reported to the

21

Agency for Enterprise Information Technology, the President of

22

the Senate, and the Speaker of the House of Representatives.

23

Reports shall enable the tracking of energy performance over time

24

and comparisons between facilities.

25

     (b) By December 31, 2010, and annually thereafter, the

26

Agency for Enterprise Information Technology shall submit to the

27

Legislature recommendations for reducing energy consumption and

28

improving the energy efficiency of state data centers.

29

     (3) When the total cost of ownership of an energy-efficient

30

product is less than or equal to the existing data center

31

facility or infrastructure, technical specifications for energy-

32

efficient products should be incorporated in the plans and

33

processes for replacing, upgrading, or expanding data center

34

facilities for infrastructure, including but not limited to,

35

network, storage, or computer equipment and software.
